Box 478 Coppell, Texas 75019 NorthAmerican FUNDING CORPORATION Re: Giving official notice, via certified mail, to all parties concerned regarding the slope failure behind the house (and other contiguous properties) located at 977 Parker Drive, Coppell, Texas Dear Mr. Griffin, After consulting with more than one civil engineer with geotechnical experience, I have been informed that the uncompacted fill dirt, placed behind mine and my neighbors homes, will continue to collapse and slide into Denton Creek. That ifa barrier is not constructed that will protect the "cut bank", soil will continue to erode which will eventually effect our foundations. To date, I have tried to inform and involve those with whom I believe have knowledge regarding this situation; and with whom I believe are responsible for the banks failure and liable for the repair. * Mr. Ron Reed and Whitney Smith of Reed Engineering, 214-350-5600, with whom I have requested information (April 14, 1995 letter enclosed) and have spoken too on a number of occasions. We also met personally last Friday 4/21/95. * Mr. Ken Griffin/City Engineer of Coppell, 214-304-3679, with whom I met at my house on 4/10/95 and requested information (as listed in the enclosed letter dated April 10, 1995) of which I have received most of the requested information. * Mr. Robert Morris of Home & Apartment Builders Association, 214-631-4840, with whom I have spoken and corresponded with as per the enclose letters dated April 13,17&20, 1995. * Mr. John Moore, President of Westchester Homes, 817-481-7750 ext. 108, who has provided limited response of which I have enclosed all of his correspondences to date (April 1 & 12, 1995) and my most recent letter to him dated April 20, 1995. * Mr. Pat Atkins of Tipton Engineering, 214-226-2967, with whom I have only spoken to once, on April 12, 1995, and who promised to call me back to schedule a date for a meeting. To date, he has not returned the calls I left with him on April 17,18,20&21, 1995. I write this letter in hopes that ail parties concerned will voluntarily get together in order to begin planning for the repair and reconstruction of the subject bank. However, in light of the poor response I have received to date, from those most involved with the land development and construction of my home, I plan to begin interviewing legal counsel this week.
