RE: Slope failure along Denton Creek in Villages of Coppell III
Dear Mr. Griffin,
On April 30th, 1995, a meeting of homeowners who reside along Denton Creek in the Villages of Coppell III, took
place to discuss the slope failure that is occurring along the creek, and to decide on a plan of action for jointly
addressing a problem that is threatening the structural integrity of all of our homes. At the meeting, Steven W.
Smith (977 Parker Drive) told the group of his numerous efforts to encourage the responsible parties to take action
to resolve the problem. Those Steven has spoken with or contacted include:

To Steven's disappointment, no party nas acknowledged responsibility for the problem and no action has been
taken to date. Because of the inaction of all the parties involved and because the problem is affecting all of our
homes, the group has decided to collectively ~ek a resolution. Thus the purpose of this letter is to officially notify
all interested parties of the complaint registered by the homeowners listed below.
As is evident by any visual inspection of the creek bank, abnormal erosion and bank failure is taking place behind
the houses located on 973,977, 981, and 985 Parker Drive. After consulting with numerous civil engineers, the
homeowners understand that due to the failure of the developer to properly secure fill dirt added along the creek to
modify the 100 year flood plane, bank failure will continue to take place. In addition to the foundation problems
all homeowners will eventually experience, the erosion has already made parts of our premium lots unusable.
Also, the erosion and spillage of soil into Denton Creek, has raised concerns regarding possible interference with
flood and drainage control.
Because delay in resolution of this problem will adversely impact each of our homes, the homeowners request a
prompt reply ~ our complaint. We encourage the involved parties to perform a close inspection of all of our
properties. In addition, in accordance with the Residential Construction Liability Act (RCLA), we also request the
responsible parties to present a plan to resolve this issue to the homeowners within forty-five (45) days of receipt of
this letter.
We look forward to working with you to resolve this matter quickly.
