I thought you might be interested in this letter I received from the land
developers attorney.
It appears he wants to cof~ribute to a legal war chest so I can turn around an¢l
sue various governmental entities of my choice.
Also enclosed is a letter I sent to you and Coppell's legal counsel, Pete Smith,
on May 17th. I have yet to receive an opinion as to ~issue' of the slope failure.

I am in receipt of your letter dated May 15, 1995, attached,
In this letter you say, "This lette~ w~ll serve as the requested response to those issues." It'
you are re,trig to something the c~ty attorney Ku told me, I want to make it clear that
he has told me nothing.
Since you and ),our attorney have said nothla8 regardJns the 'issues# as stated in the
above mentioned letter. I request that the City of Coppelrs attorney d~afl a letter,
addressed to all of the affected residents, as to the city's position regarding the issue of the
slope failure.
In addition, the letter dated May 5, 1995 was dra~ed, signed and mailed by my neighbors.
They asked my wife and I to also consider sisnin8 the subject letter.
I hope you have read the professional report, dated April, 1994, (included with the
certified letter I sero to you dated May 10, 1995) which was drafted by Ronald F. Reed.
Pon is the civil engineer that did all of the 8eote~h reports reLUin8 to the land
development where my house is located.

Re: Grand Homes, Inc.
Dear Mr. and Mrs. Smith:
This letter is an offer of compromise and settlement of all
claims and causes of action you might have against Grand Homes,
Inc. or Grand/Lakes of Coppell III and any of their predecessors or
successors in interest and their officers, directors, shareholders,
agents, employees or partners relatlng to erosion, subsidence or
slope failure of your property along the creek bank or otherwise.
The offer is $2,000.00 cash, payable upon your execution of a
full and complete Release in a form satisfactory to my clients. My
clients will also assign to you all claims and causes of action
they might have, with respect to your property, against the
engineers and excavation contractor involved in planning, designing
and construction of the subdivision.
In the alternative, my clients are willing tO reimburse you in
an amount not exceeding $2,500.00 for attorney's fees expended to
obtain remedial action by the Denton County Levee Improvement
District, c~ty of Coppell, u.~. Army Corps of ~gineere .or any
other governmental entities or parties who might be responsible or
willlng to assist.
Under either alternative, you must indemnify and hold my
clients harmless from any claims of Westchester Homes and their
successors in interest.
