Assistant City Manager/City Engineer 255 Parkway Blvd. Coppell, Texas 75019 Regarding: Public Hearing on 20th July, 1995 - Case No. ZC-583 Dear Mr. Griffin: We have been informed that the City of Cvppell will meet to discuss zoning changes on Case No. ZC-583 on 20th July, 1995. We will not be able to attend the public hearing, however, we have very strong objections to this change due to the multiple discussions, letters and meetings we have had with you regarding the significant erosion problems already occurring down stream from the property listed in case no. ZC-583. Your office and Tipton Engineering are fully aware of the erosion problem occurring at 973, 977, 981, and 985 Parker Drive. By allowing further development up stream from these locations without resolving the current erosion problems communicated to you (representative of the City of Coppell), the City of Coppell is clearly showing reckless disregard for the properties listed above and their owners. The city should not proceed with further floodplain development until it has sound understanding of its responsibilities and the impact of their decisions. For well over a year, we have been in contact with you and other representatives of the city, the homeowners association, the developer and our builder to try to amicably resolve the erosion occurring in the drainage easement/creek front areas of our property. All parties contacted have ignored the continued deterioration of these parts of our property affected by cut-bank erosion and we are preparing to take further action. We do not appreciate the way in which we were informed of only public hearing case numbers ZC-573 through 582 (which will not be heard till 22 August, 1995). If it were not for another interested party, we would not have known of the pertinent information which truly relates to our property - Case No.1 ZC-583. Assistance City ManagerK2ity Engineer 255 Parkway Blvd Coppell, Texas 75019 RE: Slope failure along Denton Creek in Villages of Coppe!l !Il and Public Hearing on 20th July 1995, Case No. ZC-583 Dear Mr. Griffin, We wish to formally object to the proposed zoning changes in consideration of Case No. ZC-583, Creekside Estates. Your office and the city, as well as Tipton Engineering, are well aware of the creek bank erosion and deterioration problems that are occurring on my property (973 Parker, Villages of Coppell III) and my neighbors' properties (977,981 and 985 Parker Drive) which lie downstream from the property in consideration. As I understand the proposal, Creekside Estates will involve the reclamation of flood plain property along Denton Creek, just as the development of the Villages of Coppell III required. By allowing the proposed zoning changes and subsequent development on the property in question, the city is inviting additional creek bank problems for unsuspecting future Coppell homeownem. In addition, fm'ther floodplain development may have additional adverse impacts on my and my neighbors' properties. Additional development upstream from our properties will likely further restrict flood waters, causing Denton Creek levels to rise and causing the rate of water flow to increase. These changes will hasten the deterioration of our properties ultimately causing more headaches and costs for responsible parties. My property, 981 Parker Drive and neighboring properties 973,977 and 985 are currently being compromised by significant slope failure and erosion due to a combination of soil compaction issues and the cut bank flow from Denton Creek. We have been in communication with FIMA, the City of Coppell, the Developer, Builder and a number of G-eotechnical Engineering companies. To this date a resolution has not been identified. Until this situation is resolved, I believe it is negligent to allow any further development up stream from our location which is going to impact run offand flow of the creek.
