I have received a letter from TU Services concerning the lowering of a 16" gas transmission line that
is in conflict with Sandy Lake Road improvements. Their letter is requesting payment in the amount
of $318,700 for lowering of the gas transmission line that is in conflict with the roadway. A copy of
the letter is attached for your purposes. In my reading of the franchise agreement that was approved
in September of 1995, Section lA states that it covers not only distribution but also gas transmission
lines and any other associated equipment. Section 4, entitled Relocation, states that when the Grantee
is required by the City to remove or relocate its mains, laterals, and other facilities to accommodate
construction of streets, that the cost is borne by the Grantee. In reading the franchise agreement, I do
not find where existing lines, either distribution or transmission, h'regardless of whether they are in
easements to Lone Star Gas, or whether or not they supersede our right-of-way, are exempted from
this franchise agreement. In conversations with Lone Star Gas or TU Services, their initial position is
that their easement was obtained in 1915, and that it supersedes our roadway and therefore, they have
prior rights and the City should pay for the relocation of the transmission line.
I am also sending a letter to TU Services requesting that they reread the franchise agreement and lower
the gas transmission main on the basis of the franchise agreement at their cost, not the City's. With
this memo, I am requesting that you review the franchise agreement, and offer your opinion on
whether or not a gas transmission line located in an easement obtained in 1915 that crosses the right-
of-way of Sandy Lake Road is exempted from the franchise agreement, and by virtue of being
exempted, it requires the City to pay for the relocation. Obviously, it is important for Lone Star Gas
to lower the gas line during the summer months, so therefore, it is important that we take a definitive
position as soon as possible.

As shown on your plans, the proposed right-of-way limits arc 95 feet with numerous
existing and proposed underground obstructions. The south side of thc roadway has an
existing concrete parking area with gasoline tanks. The north side is an open area.
To provide adequate clearance between LSP's proposed pipeline and the 30-inch water
line, LSP must place the 16" pipeline approximately 27 feet below the existing grade.
Due to other obstructions (water lines, RCP, etc), it is not possible to place the new
pipeline above the 30-inch water line as you can see on the drawing MU$-0$1.
In order to place this new pipeline 27 feet below the surface, the only construction
technique is to directional drill. Other construction techniques are not practical for this
situation. The pipe-bending radius must be limited in order to prevent the line from being
overstressed at the required maximum working pressure, in this case 800 psig. The
proposed design uses Grade X-60 pipe in order to use the tightest safe bending radius.
After nmerous engineering calculations, a 628 foot (measured horizontally) directional
bore is required. With the added pipe required to traverse along thc curve and tie back in
to the existing pipeline, approximately 720 feet of pipe is required.
The existi, ng easement on the south side is 15 feet (7-1/2 feet each side of existing
pipeline)- It is unsafe to replace a pipeline within this e~ement; therefore a new 15 foot
permanent casement will be required east of the existing easement. Temporary easement
will be required on both the north and south sides to accommodate the boring operation.
In addition, LSP will need to close the street for one day going into the subdivision on the
north side. We may also n~d to close one lane of northbound Moore Koad (north side of
Sandy Lake Road) to accommodate this project. Please advise what requirements the
City of Coppell has for strect closings/traffic detours.
