Villages CC 1-3-CS 960312 Coppell, Texas 75019 March 12, 1996 Mr. Gary Embrey 267 Winding Hollow Coppell, Texas 75019 Re: Filling in the floodplain Dear Mr. Embrey: It has recently come to the attention of the City of Coppell Engineering Department that piles of dirt appear to have been placed in or near the floodplain on the side of your property. An on-site visual inspection on March 11, 1996 confirmed that it appears that 9 - 10 loads of fill had been placed on your property. Based on our floodplain maps, it appears as though a large portion of this fill is located within a floodway area. This is in violation of the City of Coppell Floodplain Management Ordinance #87390. The essence of the Floodplain Ordinance requires that a Floodplain Development Permit be obtained for all new construction and development within the floodplain management areas of the City. By the definition provided in the Floodplain Management Ordinance, development is "any manmade change to improved or unimproved real estate including but not limited to buildings or other structures, mining, dredging, filling, grading, paving, excavation or drilling operations located within the floodplain management areas of the City." Because you are filling in an area of the floodplain, a Floodplain Development Permit will be required. Any work on your property should be in compliance with the Floodplain Development Ordinance. By virtue of this letter, the City requests the following: All filling immediately cease and desist on the subject property. All fill placed in the floodplain be immediately removed. A Floodplain Development Permit be obtained for any filling in the floodplain. For informational purposes, to obtain a Floodplain Development Permit, the City will need technical data demonstrating that the additional fill in the floodplain will not create an increase in the elevation of the floodplain. The floodplain elevation on the east property line is approximately 470 feet above the mean sea level. A surveyor could tie these points down on your lot to give you a better understanding of where the floodplain encroaches onto your lot. Anything below those elevations cannot be filled without a Floodplain Development Permit. Enclosed is a copy of a recent topographic map that shows your property, structure and elevations. I have roughly sketched where the floodplain should encroach onto your property. As previously stated, any fill placed in the limits of the floodplain, as shown on the enclosed map, should be removed immediately. Also, attached is a copy of the final plat of Village at Cottonwood Creek Section I showing the floodplain easement on your property.
