I have this feeling a letter from the gas company is not feasible ..... Original Message ..... He indicated that he had discussed this issue with Atmos and they were unwilling to grant permission for construction to encroach this easement. He also indicated that they had consulted their attorney and that according to the language of the easement Atmos could not prevent them from using this area. He indicated to me that someone would send me the following: 1. A copy of the filed easement document 2 A copy of the attorney's opinion and/or letter to Atmos expressing their intent to construct within this easement 3. A hold harmless letter from the property owner expressly stating that they are encroaching a 50 foot gas easement with their concrete paving without permission of the ownedoperator of the gas line, and further stating that they are doing so at their ,own risk, and that the city will not be liable for any repercussions from the gas company That having been said, it would be our preference to have a letter, or permit from the gas company indicating that they are ok with the encroachment Keith R Marvin P E City of Coppell (972) 304-7044 kmarvin~,ci.coppell.tx us Keith Marvin - RE: Park West Commerce Page 2: >>> "Matthew Thomas"' <MThomasC, cadencemcshane.com> 07/12/05 8:39 AM >>> Keith, After we spoke yesterday, I spoke with Steve Markussen. I think their is still a little confusion on what exactly we have left to obtain the site development permit. It is my understanding the only thing left (besides insp fees and application) is the City of Coppell is concerned about the paving that encroaches the gas easement along beltline but the city would accept a letter to address this situation. What I am not understanding is what kind of letter, what does it need to state and who does it need to come from? What are all the options to resolve this? Thank you, Matthew
