Project # ST 97-03 Dear Mr. Murphy: The City of Coppell is concemed about the progress of this project, particularly the brick paver sections that will require closure of the main lanes to traff~c in order to complete. This letter is to remind you of the provisions in the contract concerning lane closures and completion times, "Accordingly, instead of requiring any such proof, OWNER AND contractor agree that as liquidated damages for daily (but not as a penalty) CONTRACTOR shall pay OWNER Two hundred forty dollars ($240.00) for each day that expires after the time specified in paragraph 3.1 for Completion until the Work is complete. After August 12, 2005 there shall be an additional provision for liquidated damages in the amount of One Thousand dollars {$1,000) per day for any closure of the existing four (4) lanes along MacArthur Boulevard outside the hours of 9:00 a.m. and 3:30 p.m." As also stated in the Notice to Proceed letter of June 1, 2005 "your calendar days will start June 6, 2005. If you should begin work prior to that date, then the calendar days will commence on the day work begins...(75) calendar days were bid on this project for completion of work. Therefore, if work begins on June 6, 2005, then the calendar days on the project will expire on August 19, 2005. The liquidated damage policy concerning the closure of the lanes still applies as per the contract documents." Our inspector, Rick O'Dell, has had numerous conversations with your field personnel regarding the need to work diligently and stay on track so that the August target date can be achieved. From my observation today, it appears that you will need to take additional steps to meet that time flame. I am therefore requesting an updated schedule that will show the steps you are taking in order to complete the project within the time specified.
