Central Expressway, Suite 1000 Dallas, TX 75206 RE: Park West Commerce Center/Lot 2R-3, Block 2 Dear Mr. Markussen: The City of Coppell is in receipt of a copy of your July 20th letter to David Cromer of Atmos Energy and the response letter of August 1st from David Cromer of Atmos Energy. These communications were prompted by a comment during plan review stating, "Prior to constructing anything within that (Atmos) 50' easement we will need a copy of the documentation allowing the construction." We appreciate the effort you expended to remove the fire hydrant, water line and water service out of the easement area. As it stands today, you are proposing no additional facilities in the easement; therefore, we have no rights or interests in the area. After consulting with the City Attorney, our stance is that the two parties (Majestic Realty and Atmos Energy) must reach an agreement between themselves for resolution of the issue. The City of Coppell will no longer restrict your activity within this easement. If you have any questions, please contact this office at your convenience. Sincerely, Keith R. Marvin, P.E.
