Approval of this agreement will allow the resurfacing of a portion of Northlake Woodlands Phases I through 5, as
identified in the Infrastructure Maintenance Fund 5-year plan for FY 04/05,

Consider approval of an Interlocal Agreement with Dallas County to repair and overlay the
asphalt paving in Northlake Woodlands Subdivision, Phases 1 through 5, with Dallas
County furnishing labor, materials and equipment to perform the work; and authorize the
City of Coppell paying a cost of $149,966.60, as budgeted in the IMF; and authorizing the
Mayor to sign.
The city budgeted $150,00 this year in the Infrastructure Maintenance Fund (IMF) for rehabilitation of
asphalt streets within the Northlake Woodlands Subdivision, Phases 1 through 7. We anticipated that
the money would cover the rehabilitation of approximately one-third of the streets within that area.
The city approached Dallas County for a cost proposal for the paving work. The proposal submitted
indicated that Dallas County could perform spot repair as necessary and asphalt overlay, of more than
50% of the streets in the target area, within the budgeted amount. Dallas County has completed
several asphalt paving projects within town where there was some cost sharing involved. However,
due to the residential nature of these streets, the city will be responsible for the entire cost.
The attached exhibit shows all the streets within the Northlake Woodlands Subdivisior~, Phases 1
through 7. The streets highlighted in yellow are the ones that Dallas County will be repairing and
overlaying under this Interlocal Agreement. The streets highlighted in red will be repaired with IMF
funds in the next budget year. The streets in red have concrete curb and gutter that will need repair
prior to Dallas County being able to pave those streets.
Staff recommends approval of the Interlocal Agreement with Dallas County for repair and asphalt
overlay of various streets within the Northlake Woodlands Subdivision, Phases 1 through 5, in the
amount of $149,966.60 as budgeted in IMF funds.
Staff will be available to answer any questions at the council meeting.

~urine Dickey, Con~issioner of District kb. 1 , the following order was adopted:
the City of Coppell has requested that the Cor~issioner of District No. 4 overlay
various Type "E" avenues, roads or streets, as further described by Exhibit "A";
and
WHEREAS,
the estimated cost for the total project is $149,966.00 of which 100 percent, or
an amount of $149,966.00 has been deposited with Dallas County for expenditure
for project cost prior to the commencement of construction; and
the City of Coppell has executed the attached City/County Agreement authorizing
said work in accordance with Chapter 791 of the Texas Goverrunent Code; and
said roads being Type "E" according to the Dallas County Road and Bridge Policy
as adopted in Court Order No. 84-659 and Order Nos. 90-1964 and 94-1148,
establishing and updating the County Road List, is eligible for County
cooperation.
IT IS THEREFORE ORDERED, ADJUD~F~D AND DEC~EED that the Commissioners Court approves the
project listed in the Approval of Interlocal Cooperation Project and authorizes the County
Judge to sign such document prior to the approval of the Interlocal Agreement for the
construction, reconstruction, improvement or repair of the roadways listed in the attached
Approval of Interlocal Cooperation Project Order.
IT IS FURTHER ORDF.~ED, ADouuG~D AND DECREED that the Commissioners Court, subsequent to the
approval of the project in the Approval of Interlocal Cooperation Project does hereby approve
the Interlocal Agreement between the City of Coppell and Dallas County for the construction,
reconstruction, improvement or repair of various Type "E" Streets,

APPROVAL OF INTERLOCAL COOPERATION PROJECT
The County of Dallas, acting by and through the County Commissioners Court,
having been advised of a project to overlay of numerous avenues, roads or streets, as further
described in Exhibit "A" attached, all located within the City of Coppell ("City"), under an
Interlocal Contract, herein gives its specific written approval of the project prior to beginning
the project in satisfaction of the requirements of V.T.C.A., Government Code, Chapter 791,
the Interlocal Cooperation Act, Section 791.014.
The description of the type of project to be undertaken and its location are as follows:
overlay of numerous avenues, roads or streets, located within the City of Coppell.
The local government which requested the project and with which the County of
Dallas has contracted is the City of Coppell.
By vote on this date, the Commissioners Court has approved the project identified
above and authorized execution of this document by the presiding officer on behalf of Dallas
County, Texas.

BETWEEN DALLAS COUNTY AND CITY, TOWN OF COPPELL
FOR OVERLAY OF NUMEROUS AVENUES, ROADS OR STREETS:
SEE ATTACHED ESTIMATE FOR LEST OF AVENUES, ROADS, OR STREETS
WHERE AS, the City of COPPELL, Texas, hereinafter called "City", and the County oic
Dallas, Texas, hereinafter called "County", desire to enter into an interlocaI agreement for the
purpose of overlay of streets as shown on attached estimate, as further described by exhibit '~A"; and,
WHERE AS, Chapter 791 of the Texas Government Code, as amended, provides
authorization for local governments to enter into interlocal contracts;
NOW THEREFORE, THIS AGREEMENT is hereby made and entered into by City and
County for the mutual consideration stated herein:
WITNESSETH
City has requested and County agrees to overlay on listed Avenue, Road or Street,
hereinafter called the "Project", as further described in Exhibit "A" attached hereto and incorporated
herein for all purposes. The Project is classified as a County Type "E" road project.
Count,/agrees to furnish materials, labor and equipment necessary and to perform the Project
construction at a cost not to exceed $149,966.00, hereinafter called the "Not to Exceed Amount".
III.
City agrees to pay to County the sum of $149,966.00 as City's portion of the cost of the
Project. Such amount will be paid to County prior to the commencement of construcuon. Such
amount will be deposited with County prior to the commencement of construction and County ~s
authorized to expend such amount for periodic payments of Project cost.

IV.
City agrees to accomplish the following items, if required by the proiect, m a timely manner
to insure that such ~tems will not delay the County construction schedule; (1) inform the public of
the proposed reconstruction of the Project; (2) locate all manholes, water valves, and other utilities
within the Project; and (3) make or cause to be made all utility relocations or adiustments necessaty
for the Proiect at no cost to Counw.
In the event that the cost of the ProJect shall exceed the Not to Exceed Amount, City and
County agree to either reduce the scope of construction or seek additional funding to compIete the
project. At the terminauon of the Project, County will do a finaI cost accounting of the Project. In
the event that the amount paid by City exceeds the actual cost, the difference will be remitted to
City. In the event that additional funds are due, County will bill City who agrees to pay such funds
within thirty (30) days of receipt of such billing.
VI.
The term of this agreement shall be from the date of the last s~gnature approving the
agreement until the completion of the Project and final payment as provided herein.
VII.
The City agrees that County shall have the right to enter upon the Project area for the time
period necessary for the completion of the Project. City agrees to furnish such police personnel as
requested by County for traffic control or other public safety matters at no cost to County.
VIII.
The County agrees to be responsible for any liability or damages the County may suffer as a
result of claims, demands, costs or judgments, including all reasonable attorneys fees, against the
County, including workers compensation claims, arising out of the performance of the construction
and services under this agreement, or arising from any accident, injury or damage, whatsoever, to any
person or persons, or to the propertT of any person(s) or corporatton(s) occurring during the
performance of this agreement and caused by the sole negligence of the County, tts agents, officers
and/or employees.
IX.
The City agrees to be responsible for any liability or damages the City may suffer as a result
of claims, demands, costs or judgments, including reasonable attorneys fees, against the City,
including workers compensation claims, arising out of the performance of the construction and
services under this agreement, or arising from any accident, injury or damage, whatsoever, to any
person or persons, or to the property of any person(s) or corporations(s) occurring during the
performance of the agreement and caused by the sole negligence of the City, its agents, officers
and/or employees.

City and Count5' agree that any liabiliw or damages as stated above occurring during the
per£ormance of this agreement caused by the joint or comparative negligence of their employees,
agents and officers shall be determined m accordance with the comparative responsibility laws of the
State of Texas.
City and CounW agree that CountT's obligation to perform the Project construction is
contingent upon the receipt of City's payment of $149,966.00 and no construction on the Pro~ect
will corr, mence prior to the receipt by County of such payment.
This Agreement shall be expressly subject to the sovereign immunity of County and the
governmental immunity of City, Title 5 of the Texas Civil Practice and Remedies Code, as amended,
and all applicable federal and state law. This Agreement shall be governed by and construed in
accordance with the laws and case decisions of the State of Texas. Exclusive venue for any legal
action regarding this Agreement flied by either City or county shall be in Dallas County, Texas.

Enclosed with this letter are the two interlocal agreements between Dallas County and the
City of Coppell to be executed by Dallas County. As stated in the agreements, we will
send payment of $61,169.75 for the Southwestern Blvd. project and $149,966.60 for the
Northlake Woodlands project once we have received the executed documents.
