As you are aware, the above referenced claim has been referred to our office by the City of
Coppell for handling. .
We have now completed our investigation surrounding the facts of this loss. Our investigation
has revealed this loss occurred as the result of sediment entering the water lines after the purging
of the line by City of Coppell personnel and was in no way related to any activities performed by
M-Co Construction. The City of Coppell's NCTCOG (North Central Texas Counsel of
Government) specifications, as they relate to this type of project, clearly state only City
personnel will perform line purging, sterilization, and bacterial testing.
In accordance with Civl Practice and Remedies Code, CPRC 101.021. Governmental Liability,
the city and their employees have official immunity for the performance of discretionary duties
within the scope of the employee's authority, provided the employee acts in good faith.
Additionally, the Civil Practice & Remedies Code stipulates "the municipality is not liable for
damages arising from its proprietary functions, which are functions that a municipality may, in
its discretion, perform in the interest of the inhabitants of the municipality, including but not
limited to the operation and maintenance of a public utility." Therefore, we find no liability on
the part of the City of Coppell as it relates to this loss. On behalf of M-Co Construction, Ed Bell
Construction and the 'City 0£ Copp~ll, we respectfully deny any and all claims presented as a
result of this loss.
