HEARING DATE: December 16, 1993 January 11, 1994 LOCATION: Along the south side of Beltline, 1,650 feet east of MacArthur Blvd. SIZE OF AREA: 2.0 acres of land. CURRENT ZONING: (L1) Light Industrial REQUEST: Approval of a zoning change from Light Industrial (LI) to Light Industrial Special Use Permit (LI. S.U.P.) APPLICANT: Mr. Barry Johnson (Owner) 1002 Rolling Brook Coppell, TX 75019 HISTORY: No history on this parcel. TRANSPORTATION: This two-acre site has frontage on and access to Beltline Road which is classified as a primary six-lane divided thoroughfare. Item 7 SURROUNDING LAND USE & ZONING: North - Vacant; (MF-2) zoning South - Vacant; Grapevine Creek Channel East - Vacant; Proposed Self-storage facility West - Vacant; (LI) zoning COMPREHENSIVE PLAN: The area of MacArthur Blvd. and Beltline Road has been designated as a special land use category for mixed uses since it is considered as a gateway into the City. ANALYSIS: This particular use, is a use which is suitable for this mixed-use area, as described in the Comprehensive Plan, as an entry into the City. The Coppoll Park Board has suggested that the applicant provide a 30' easement for the citizens' use as a Hike and Bike trail, along the rear (south) portion of the Blooming Colors Nursery, as well as along the rear of the mini-storage facility and the church. Each applicant has indicated that it would be impossible to provide such an easement based on the plans already submitted for review. A 20' maintenance and access easement presently exists between the rear of these properties and the Grapevine creek channel. Negotiations for a commitment to share this easement have not worked out as staff had hoped. During our development review process, we asked the representative for each of the properties, to request permission to share the easement. An attempt was made by the applicant's representative, but the response from Paul Phy, representative of Irving Flood Control district, was that the flood control district could not be responsible for liabilities as a result of the use of the easement as a Hike and Bike trail. Since this is a suggestion made by the Park Board, and has not yet been adopted by ordinance nor accepted by the City, staff hesitates to require the easement as a condition of approval, otherwise, we have no objection to the approval of the zoning change request.
