Ratliff, City Manager Larry Jackson, City Attorney Brazos Electric Power Cooperative Memorandum Dated May 31, 1988 Morton/Ratliff In response to Councilman Morton's inquiry concerning the above referenced memorandum I offer the following: 1. Why was this notification sent to the City of Coppell? The city was sent notification because the Brazos transmisison line requires an amendment to the Brazos Electric Cooperative's Certificate of Convenience and Necessity which must be approved by the Public Utility Commission. The City is required to be notified of this amendment. Does the City of Coppell have any jurisdiction over the construction of any portion of the line and/or substation located in the corporate limits of the City of Coppell? The City of Coppell does have jurisdiction of construction of the transmission line and they will be coming in for the necessary building permits. The new substation will not be within the corporate limits of the City of Coppell. Alan D. We will not be collecting a franchise Brazos Electric's transmission lines private easements. fee because will all be on The City can not require the Cooperative to screen its facility which has been located in the City of Coppell since 1940; however, it is my understanding that the present location may be scheduled for some cleanup work in the near future. The transmission line contemplated will be above ground in that it will carry in the vicinity of 69,000 to 138,000 volts. I do not believe the city could require this line to be placed underground in this location. Does the Cooperative currently have a right-of-way through the City of Coppell? If yes, is the alignment of the current right-of-way indentical to the one stated in the notification "LEGAL NOTICE" and is their right-of-way seventy (70) feet in width? My investigation has determined that the line will be constructed totally on private easement and will not involve any of Coppell right-of-way. Brazos Electric does not, at the present time, have all of the right-of-way secured, but will be negotiating for such right-of-way in the near future or obtaining it by condemnation. They will be requiring a 70' right-of-way for this transmission line. Please advise if I may be of further assistance in this matter. LJ/dgc
