Box 17300 Fort Worth, Texas 76102-0300 Re: Modification of Tributary G-1 Downstream of Bethel Road West USACE Project No.: 200400181 Dear Mr. Swihart: As required in the approved miligation plan cited in special condition 1 of the U.S. Army Corps of Engineers (USACE) permit letter dated May 4, 2005, the following information is submitted for your records. This letter constitutes the first annual written compliance report, due October 1, 2005 as stated in the miligation plan cited in special condition 1 of the above mentioned permit letter. The deed restriction for the stream m/t~gat~on area ~equired under condition 2 of the permit letter is still being developed. The City of Coppell has made initial contact and met with the current property owners and is negoliating for attainment of easement or right-of-way to facilitate modification to the stream channel and approved mitigation. Possible land swap as compensation for the right- of-way is being discussed. As a result of the ongoing negotiations, it is unlikely that the deed restriction will be finalized by the November 1, 2005 date stipulated in condition 2 of the permit letter. The City wishes to request a modification to condition 2 of the permit letter so that a draf~ deed restriction is required to be submitted to the U§ACE for review and approval, and the recording of the USACE al~roved deed restriction _w~..th ~.e Co..un~ SL~k- t~ completed prior to c~amcncement of any ground-distucomg activity wmm, jurisdictional reach of the waters of the United States. No construction activity has been initiated along the Irit)utaty channel to date. The City of Coppeli is working in conjunction wifla the City of Grapevine who is planning to reconstruct their portion of Bethel Road (Bass Pro Road within Grapevine). The two cities would like to bid the two projects together in order to minimize costs. The anticipated schedule of activities based on this ass~maption is provided in Table 1 below.
