Box 478 Coppell, TX 75019 Re: Median Strip Irrigation Line Replacement Dear Sirs= We have been following the situation regarding the replacement of the irrigation line to the city owned median strip located in front of our property. We are very disappointed that city officials have been unwilling to share the burden in this item. It is our understanding that all utility line locations were requested by our contractor prior to excavations starting, and that the line in question was not located by city personnel nor any others. It is our understanding that the location of the line in question was unknown by any party until it was located by accident during the construction of the drive approach to our property. It is also our understanding that the line was initially installed incorrectly in that it was not installed as deep as city requirements would dictate. Your letter of March 10, 1995 states this fact. With these understandings, it is under protest that we replace the city owned irrigation line. The City of Coppell failed to require that the line was installed correctly to begin with. The City of Coppell failed to locate the line such that damage could be avoided. The City of Coppell is now requiring that we replace the existing line with a higher standard than required when it was initially installed. It is no fault of the owner or the contractor that the line was c~unaged. It is unjust and inunoral that we, the owner, are being punished in this manner for others' derelict of duty. In concert with a lack of city building officials negotiating in good faith, the fire marshal is now pressuring us to cease the delay in installing the drive approach while we appeal the repair decision. He is requiring that the drive approach be completed or threatens to shut the project down. We feel that we are the object of an orchestrated effort to unfairly force this repair at our OWn exl)ense. As the owner, we appeal the decision of the City of Coppell not to help with the cost of this repair in any way. We appreciate the requirement that no fittings be located under street pavement. We feel that a brazed connection would allow the repair to be facilitated in agreement with this requirement yet reduce the cost significantly. We do not feel the city is Justified to require the repair to be of higher quality than that which was d~maged. We also do not feel that the city is Justified in requiring the repair to a line that no one knew the location of. We feel greatly maligned in that the city is not even willing to share the burden caused by their own failures. Please send me a response to this appeal allowing us to better understand why the faithful tithe payers who are paying for this facility are being unfairly punished. MacArthur Coppell, Texas 75019 RE: 2" Irrigation Service for Median Adjacent to the Church of Latter Day Saints Project Dear Mr. Cardwelt: Per our discussion this morning I am sending this letter to inform you of the city's requirements for water services under pavement. The above referenced service line was damaged during pavement construction for the Latter Day Saints project. During the repair it was discovered that the service line was too shallow and that the repair itself would be under newly poured concrete. The city's current standard is that no fittings on a copper service line be allowed under street paving; therefore, you are required to 1). re-bore and lower the service line to at least 18" below subgrade of pavement, and 2). the new service line must be one full length of copper with no connections from the water main to one foot outside back of curb, in the median where water meter is located. By copy of this letter I am informing our Construction Inspector Larry Davis that this request has been made. If you have any questions regarding this matter, please contact me at(214)304-3545.
