Re: Development of Mills Lane
Gentlemen:
As a part of its acquisition of a high school site, CISD
currently has title to a 24 foot wide strip of land from Denton
Tap Roa~ known as Mills Lane. This same 24 foot right-of-way is
to be also used for construction access to CISD High School site.
The property Owners along and each side of said 24 foot wide
strip have been using Mills Lane for access to their respective
tracts along with the general public for access to Willow Lane
for over 15 years.
In light of recent conversations concerning the ~ast and future
use of Mills Lane we are in agreement that the dedication of
right-of-way and subsequent construction to City of Co~pell
standards would be a benefit to all parties. The centerline of
the 24' strip of land known as Mills Lane shall be the
centerline of the street to be constructed. In an effort to
confirm our mutual objectives for Mills Lane and to encourage a
construction time table we agree as follows:
1. It is the desire and intent of the parties to agree on the
future improvements of Mills Lane. Accordingly, all parties
shall dedicate rights-of-way to the City for future construction
of Mills Lane.
CISD shall dedicate its 24 foot strip of property to the City of
Coppell shown as Tract 2 on Exhibit "A". The Parks of Coppell
Joint Venture and the Belt Line 4.5 Partnership shall dedicate
land as follows: (i) In the event a 50 foot right-of-way is
required by the City for a 27 foot paving section the property
owners along and either side of the CISD's 24 foot wide strip
agree to each donate up tp 13 feet along and parallel to the CISD
24 foot strip; (ii) In the event the City of Coppell requires a
60 foot right-of-way for a 44 foot paving section then each of
the property owners adjoining the CISD's 24 foot wide strip agree
herein to eachdedicate up to 18 feet in lieu of the width in (1).

Not withstanding the street size variation mentioned in the
paragraph immediately preceeding the cost for the construction of
Mills Lane shall be prorated and paid 1/3 by the CISD and 1/3 by
the property owners on the northern side of the CISD 24 foot
strip and 1/3 by the property owners on the southern side of the
CISD 24 foot strip.
As soon as engineering plans are finalized and determination is
made by the City on the right-of-way width, each of the property
owners on the north and south side of Mills Lane will dedicate
the appropriate width of right-of-way. CISD agrees herein to
donate its 24 feet width for right-of-way purposes upon written
request by the City or any one of the parties below.
In addition to each party's respective dedication of land, each
party agrees to to pay its prorata cost for construction of Mills
Road on the 1/3, 1/3, 1/3 cost basis set out above. Each party
further agrees to reimburse the party first constructing said
street for its 1/3 share of the cost not later than ~ years from
the date of payment by the party paying for such costs. The
prorata reimbursement to the party constructing the street and
incurring such expense shall also include an interest rate based
on the prime interest rate of North Dallas Eank & Trust and be
calculated as simple interest for each day the reimbursement
obligation is in effect.
Since they have such obligation as
their Tract, the CISD agrees to pay
structure required under Mills Lane.

In order to permit Mills Lane to have access into the high school
site without the necessity for a cul-de-sac, the CISD agrees to
construct Mills Lane from its terminus listed as point "E" at the
cost and expense of CISD. This cost and construction shall be
done in a manner to permit access onto the CISD private drive
shown as Point "C" and noted on the attached Exhibit "B".
The cost of the roadway system shall include but not be limited
to the construction, paving, drainage and other required public
utilities, engineering, staking, platting, and supervision,
including any fees to the City of Coppell. During and until such
time as a right-of-way and street has been constructed, CISD
agrees to keep the 24' strip open for public use and access to
the adjoining property owners and to the general public.
