PA0001-CS040809COl'FELL August 9, 2004 Rex Shelley American Civil Constructors, Inc. 3925 Carbon Rd Irving TX 75038 RE: Maintenance Bond Repairs MacArthur Park #PA 00-01 Parking Lot Expansion Dear Mr. Shelley: In response to your letter of August 5th regarding the striping of fire lanes in MacArthur Park, the following is the City of Coppell Engineering Department's position: According to the wording in the Maintenance Bond that states, "Principal will furnish a bond conditioned to guarantee for the period of two years after approval...against all defects in workmanship and materials which may become apparent during the said period...". Further stated in the bond, "the Principal shall indemnify the Obligee for all loss that the Obligee may sustain by reason of any defective materials or workmanship which become apparent during the period...' Because of excessive wear and unusual fading, we feel that substandard paint and workmanship was used for fire lane striping and we are, therefore, at this time attempting to exercise our rights under the terms of the bond.
