Dear Mr. Doyle:
We have reviewed the attached agreement and offer the following
comments.
The exhibits referenced in the agreement, Exhibits A through D,
were not included in our copy of the Agreement.
Construction plans for the lake need to be submitted to the DRC
before complete evaluation can be made regarding the Agreement.
In general, we agree with Mr. Larry Jackson. The Agreement
appears to be too one-sided putting more emphasis on the City's
acceptance and maintenance of the streets, utilities, and the
lake rather than on the quality and standards of construction of
the lake. No construction plans as stated above have been
submitted yet to the DRC staff showing normal pool elevations
anticipated, water levels (high & low), overflow control,
provisions for maintaining water levels in exceptionally dry
climate periods, aeration, liners, soil borings, etc.
With the above information and some design/construction
standards and parameters established for the lake in the
Agreement, just as was done with the proposed Univest lake West of
MacArthur and North of Moore Road, we feel an Agreement on this
subject could be entertained.
