Misty Haven R.O.W. - Linda Williams Request
The president of the homeowners association, Linda Williams,
contacted me and asked that I look into the strip of land that runs
between Misty Haven and the alley for the homes on Winding Hollow
Court. She said that there was debris and high grass on this
property and that she wanted to know if it was in the city R.O.W.
I looked at the plans for this area which do indicate that this is
within our R.O.W. and is beyond the 15' criteria set for homeowner
maintenance as well. I then looked at the property in the field
and determined the scope of the problem. There was in fact debris
and high grass in this area.
After my research, I scheduled the R.O.W. crew to clean up this
property and mow the high grass and weeds. This took place on
5/13/92. At this time I also contacted Linda Williams and told her
we were doing the cleanup and that I would be checking with
Planning to see if this was designated as a common area which would
be the homeowners' responsibility to maintain. Mrs. Williams did
say that up until all the debris was dumped there, the neighbors
kept it mowed. I told her that we would be checking the area on a
two-week basis to see if it needed mowing and that unless there was
something that required the homeowners to maintain this area, we
would be mowing it in our regular schedule.
I have since looked at the plat and there is nothing that calls for
the homeowners on Winding Hollow Court or the homeowners
association to maintain this property. Therefore, staff has placed
it on our schedule to maintain and mow on a regular basis.
