Attached is a copy of the contractor's final response to our requests that they repair the damaged driveway. As you can see, they attribute the failure to traffic loadings which were not anticipated for a driveway of this tYpe. Additionally, the damaged area, to the best of our knowledge, is beyond the ROW on private property and is not the responsibility of the City. Consulting Engineers 17103 Preston Roadt Suite 100, L.B. 118 Dallas, Texas 75248 Re: Denton Tap Improvements Dear Mr. Karlsrusher: Your recent letter to Mr. Mike Lacy, regarding a driveway problem at Northlake Nursery was referred to me for handling. We learned at a meeting and on-site inspection with Mr. Fikes that this driveway in question is used for truck deliveries grossing 80,000 lbs. and tandem truck loads of fill materials, both of which have a wheel loading greater than that of normal vehicular traffic. We are not at all surprised ~hat a failure occured under these condi- tions as it would most certainly do again and again until replaced with pavement of adequate design. It is not apparent to us that this failure was, in fact, caused by unsatisfactory workmanship and mater- ials as your letter states. It should be noted that this driveway has an abrupt change in grade and a limited area of entry for large vehicles which necessitates a turn before the driveway is cleared. This condition should be addressed in consideration of design changes to handle heavy truck loading. Our conclusion is that replacement of a similar design driveway would not have economic support nor would it resolve the problem for the owner.
