The purpose of this memorandum is to respond to comments made in
the above referenced memorandum. I first want to thank you for
working with the homeowner to gain their signatures on the hold
harmless agreement.
Then I would like to state that I don't remember meeting Mr. Medina
and discussing this matter.. I do remember meeting with Russell
Doyle and Jim Street in February of 1990 to discuss the issue. I
informed Russell and Jim that I had some concerns about the wall
being built there, but as long as Jim understood that the City
would hold the homeowner responsible if the wall should have to be
removed to access or repair the sanitary sewer line located in the
easement. Russell failed to follow through with an agreement at .
that time and when I found out that an agreement had. not been~
signed, I notified you. In a memorandum dated December 12, 1990,
I informed you of this and requested that you follow up. I am very
sorry that the homeowner was so upset, but I feel that this issue
could have been resolved prior to issuance of a permit for the
wall, without incident.
