As you are aware, the retaining wall constructed at 154 E. Bethel
Road encroaches the 20' Sanitary Sewer easement approximately 10'.
I remember discussing this issue with Russell Doyle in February of
this year. After a meeting with the builder of the structure on
that lot, I informed Russell that I didn't have a problem with the
design of the wall or the encroachment of the easement. I later
found out that there was never any follow-up to this matter.
Therefore, attached you will find a copy of a hold harmless
statement drafted by the City's legal staff to utilise for this
purpose. Please take the necessary steps to have the homeowners
process this document. Once the document has been processed, I
would like to have a copy for my file.
