Re: Denton Tap Road Improvements - Executive Summary of Status
Dear Mr. Goram:
As per Mr. Doyle's request we are forwarding an executive summary
which indicates the status of each of the projects through
October 31, 1989. The reason that this report does not cover
progress through November is that the Contractor has not
submitted his application for payment for that period. As
mentioned in last week's city Council meeting, we feel that it is
a bit premature to begin trying to contemplate assessment of
penalties, damages and etc. As you can see there is still a
substantial amount cf work to be completed by the Contractor as
well as requests for additional compensation and contract time
extensions to be evaluated.
In conversations with the project superintendent last week it was
mentioned that L. H. Lacy Co. is anticipating submitting further
claims for additional contract time and compensation which will
have to be evaluated. In cases such as this it has been our
experience that the City of Coppell will be better off to allow
us to receive and evaluate all claims and requests for Change
Orders and negotiate a final contract amount with the Contractor
prior to the City Council considering the assessment of penalties
and damages. The final project report we have mentioned at the
last two city Council meetings will cover all of the issues and
make a recommendation of a final payment amount.
We caution the city only to avoid further complications with the
Contractor. If the Contractor begins to get the idea that the
city intends to rigidly enforce the liquidated damage provisions
of the contract without any other considerations regarding
delays, etc., his efforts may be concentrated on finding ways to
file claims and time extensions to offset liquidated damages
instead of on expeditious completion of the work, which is the
most important and beneficial item for all concerned.

to Sandy Lake Road Project Status Through
October 31, 1989.
Paving and Drainage construction is complete with the exception
of small blockouts at the Bethel School Road intersection and
paving markings in some areas.
Bridge construction at Grapevine Creek is complete with the
exception of painting, decorative street light system, and paving
markings.
Seeding for erosion control in progress with rye grass being
planted in the medians, parkways and on slopes. Median grass
will be replaced with bermuda under the Landscape Contract by
others.
We expect final application for payment to be submitted in late
January or early February, 1990.
