Box 478 Coppell, Texas 75019 Re: Denton Tap Road Improvements - Executive Summary of Status Dear Mr. Goram: As per Mr. Doyle's request we are forwarding an executive summary which indicates the status of each of the projects through October 31, 1989. The reason that this report does not cover progress through November is that the Contractor has not submitted his application for payment for that period. As mentioned in last week's city Council meeting, we feel that it is a bit premature to begin trying to contemplate assessment of penalties, damages and etc. As you can see there is still a substantial amount cf work to be completed by the Contractor as well as requests for additional compensation and contract time extensions to be evaluated. In conversations with the project superintendent last week it was mentioned that L. H. Lacy Co. is anticipating submitting further claims for additional contract time and compensation which will have to be evaluated. In cases such as this it has been our experience that the City of Coppell will be better off to allow us to receive and evaluate all claims and requests for Change Orders and negotiate a final contract amount with the Contractor prior to the City Council considering the assessment of penalties and damages. The final project report we have mentioned at the last two city Council meetings will cover all of the issues and make a recommendation of a final payment amount. We caution the city only to avoid further complications with the Contractor. Bridge construction at Grapevine Creek is complete with the exception of painting, decorative street light system, and paving markings. Seeding for erosion control in progress with rye grass being planted in the medians, parkways and on slopes. Median grass will be replaced with bermuda under the Landscape Contract by others.
