1. City or Developer agrees to pay Company $ in consideration of Company's agreement to install said ~'eot
lights and underztand~ that no construction work will begin until after Company has received full payment.
2. Campeny agree~ to imtall, own, operate and maintain mid street lights in accordance with itz ~tmet lighting agree-
ment with customer. However, if C'~y or Developer fails to pay~ an demand, the amount indicated above, thi~ supple-
mental agreement i~ automatically terminated.
3. ~JI parties agree that Company will retain for its uze and benefit the payment received hereunder in car~ideration of
its obligation to install mid street lights and that Company at all times hm title to, and complete awnemhip and
of, mid ~'eet light.
4. Company iz not liable far latz or injury caused by delay or failure to ir~lall the electric facilities neca~,ary to ~erve
customer because of delay in receiving shipments of required material, orde~ or formal requests of governmental
agencies, act~ of God or the public enemy, inevitable accidents, tim, e~lo~ions, strikes, ri~, war, or any other causes
reasonably beyond co,,~ro[ of Company. If Company i~ prevented from installing such electric facilitie~ by any of the
above caul, Company agrees to tatum to City ar Developer, without interest, the entire amount of City or Developer's
payment, thereby terminating th;" supplement and Company's obligation to provide the elec~c fadlities de~'ibed heroin.
5. This agreement is entered into subject to the terms of the Agreement far Street Lighting Set,dca behv~en City and
Company dated
