Devonshire 2-CN 931201HOLD HARMLESS AGREEMENT WHEREAS, THE OWNER OF LOT , BLOCK , OF THE [30 C~f.L,~ ~o,o SUBDMSION, ~O~vo.,ofl-tt~e (ADDRESS), COPPELL, TEXAS (THE OWNER) UNDERSTAND AND ACKNOWLEDGE THAT THE ACCESSORY BUILDING WHICH IS LOCATED ON THEIR PROPERTY ENCROACHES ONTO THE CITY OF COPPELL'S DRAINAGE EASEMENT; AND WHEREAS, THE OWNERS UNDERSTAND AND ACKNOWLEDGE THAT IN CASE REPAIRS OR IMPROVEMENTS ARE REQUIRED TO BE MADE TO THE CITY OF COPPELL'S DRAI2qAGE EASEMENT WHICH WOULD REQUIRE REMOVAL OF THE ACESSORY BUILDING IN ORDER TO EFFECT SUCH IMPROVEMENTS; AND WI-IEREAS, THE OWNERS RECOGNIZE AND ACKNOWLEDGE THAT SUCH ACCESSORY BUILDING WAS INSTALLED DESPITE KNOWLEDGE OF THE CITY'S DRAINAGE EASEMENT; OWNERS HEREBY AGREE TO REMOVE SUCH ACCESSORY BUILDING AT TI-I~IR OWN COST AND UPON REQUEST BY THE CITY OF COPPELL, AND 11~ OWNERS FAIL TO REMOVE THE ACCESSORY BUILDING UPON REQUEST BY THE CITY, THEN CITY WILL REMOVE SUCH ACCESSORY BUILDING AND OWNERS HEREBY INDEMNIFY AND HOLD THE CITY HARMLESS FROM ALL CLAIMS OF DAMAGE TO THE ACCESSORY BUILDING WI-~CH ARISE FROM THE CITY'S REMOVAL OF SUCH ACCESSORY BUILDING WHILE REPAIRING, INSPECTING, IMPROVING OR IN ANY WAY SEEKING ACCESS TO THE DRAINAGE EASEMENT. ADDITIONALLY, OWNERS AGREE TO REIMBURSE THE CITY FOR REASONABLE COSTS INCURRED IN REMOVING TI~ ACCESSORY BUILDING.
