RE: PROPOSED MEDIAN OPENINGS - DENTON TAP ROAD, COPPELL, TEXAS
On December 12, 1988, I received the December 8, 1988, letter
from Univest Development Company under the signature of Parks of
Coppell Joint Venture, (PCJV), Michael J. Allen. This letter
recognized your letter to me dated Nov--her 30, 1988 as correctly
describing PCJV's agreement with ABQ for location and cost
sharing of the proposed medians. He asked if I had any questions
and copied some seven (7) other people of which ! know of four
(4).
I have reviewed the voluminous correspondence made available to
this office on this matter and have had a few discussions with
you and Ginn Inc. on these median requests, including yesterday
with Jay Chester and yourself. I do not know if I have all of
the correspondence that you or someone might think that the "City
of Coppell" has and should know in responding to this/these
requests. However, toward the end of this summary and guidance
letter we will cover that.
I would like to, /n-like manner, cover the cop/us
correspondence on the Water Main requests (although you said
Friday that Ginn wants too much for going under the box) as well
as the Parkway Boulevard West Extension . While I will allude to
those other two requests for public improv,m~nts and provide
guidelines as to how to approach this office on them in general;
the specifics will be covered in separate correspondence for
expediency and clarity on each item. All of these improvements
are related to development and requests satisfied here or
elsewhere in no way acts for or precludes future decisions by
City staff, DRC, Planning and Zoning Commission and City Council.
Now to the matter of the median cuts, I will cover the letters
of record, that I know of, and then in s,,~ry cover the
procedure that you must follow and quarterback as the requestor
and applicant, etc. I hope this letter suffices for the "e~ecuted
response' you need to have, as cited in yOur Dec-m~er 22, 1988
letter.

! have sent your Nov-~her 30, 1988 letter to Ginn Inc. for a
response just as ! did your Noveshar 3, 1988 letter requesting
the necessary information and recom~endation for process. ! sent
thi~ November 3, 19.88, letter to Ginn Inc. on Nov-mh~r 4, the clay
I received it. ! then responded to you in a letter dated
November 7, 1988, that ! thought you had not received , but as
you indicated last Thursday a week you did receive it. (Even
though you have not responded to it. )
As we discussed in our telephone calls, you can use that "DPAFT"
November 14, 1988 letter as your ~uidance for proceeding with
these ~edian cuts north of Parkway. You must see that all the
proposed financial transactions are cleared and approved by Frank
Trando, Director of Finance.
Your November 3, 1988, letter carried with it an October 7, 1988
letter to Ginn Inc. with attachments. (the October 7, 1988,
letter was submitted at the direction of Ginn. Inc.). That
October 7, 1988, letter referred to a July 26, 1988, letter or
co~unication between ABO and Univest citing no progress on
agreement regarding the proposed median cuts. Further
communication between Ginn Inc. and you was requested regarding
construction schedules and 'need to know' location of median cuts
south of Parkway Boulevard. Also requested was notification from
Gian Inc. to Univest of scheduling requirements on this matter.
Then I have a letter dated Nov-~her 22, 1988, to you from Michael
R. Allen on the 'Denton Tap Median Breaks' referring to your
November 8th end 9th letters and approving stations for three
median cuts, specs on median cut widths, and no left turn lane
needed for south bound traffic at this time. One cut was
identified as Mills Lane and I am not aware of a Mills Lane
except an outlot v-~hered '2' that is currently being used as the
construction road for the New Coppell High School. As stated in
my November 7, 1988 letter, I need to see the development plans
either existing or proposed that relate to the proposed mudian
cuts. You as the applicant must furnish them as apart of your
initial request package or at least your package that will go to
the City Council for approval of the median cuts, change order,
funding etc.
There is a September 13, 1988 letter from you to Mr. Allen on
mudian breaks that was copied to Mr. l~atliff and not to me.

I hope that I have'covered the situation. I will transmit the
response to your Now~er 30, 1988, letter when I receive the
information from Ginn Inc.
In the ~ean tim, ~ay I get from your client(s) a proposal on
these madien cuts as desired. Please keep the requests separate
(e.g., North of Parkway Boulevard and South of Parkway
Boulevard). Likewise, the request to put in the related work for
your Parkway Boulevard West Addition, now in review by DRC.
The sa~e is needed reqarding the numerous requests for water
mains. I got a request from Ginn Inc. but we need the request
end proposals from your client showing what co~l~itments will be
made and when and related to what process and/or "agreement,' etc.
If you need any other information and/or need other direction,
please let me know and we can set up a meeting with the
appropriate City personnel so as to expedite your needs and
reque~.

I a~ in receipt of your letter of Noveaber 3, 1988, regarding the
subject topic. I appreciate your efforts to integrate your
develolxaent requirements into the City Public Inprove~ents, saving
· oney and items covered in the last paragraph of your letter.
I i~ediately called Wayne Ginn, and he infomed se that 3ohn
Karlsruher was looking at your letter. I have forwarded your letter
to Ginn, Inc.', the Project Hanager for the City, as well aa the City
Plan Reviewer. I will seek the information you requested, and
provide to you, as outlined below, but c~nnot guarantee the #ovmaber
15, 1988, deadline you have presented to this office. I hope that
the recent advice you received will not delay you any further than
you have been in the past. (I recall Kevin Peiffer advising you of
the requirements for this request in a DRC~eeting~anyweeka ago).
I concur that a aedian opening can be approved if the otmers on both
sides of the thoroughfare (and along the roadway on both sides, for
an appropriate distance) approve the location, etc. Traffic
Engineering Design and City Codes seat he considered; and the
funding and construction coordination aust he ~orked out. Also, you,
the initiator, aust bear the burden of providing ~flat is needed to
sake this ~ork.
Regarding your October 7, 1988 letter to Ginn, Inc., if you can not
get the agreement on the aouthcuta, perhaps we could still get
construction joints in position, so as to not require saw cutting,
etc. You have obviously gotten soae answers to this letter, since
you cite the Deceaher, 1988 paving start.

I can not necessarily authorize Glen, Inc. to include the
Cuts north of Parkway Boulevard, until ~e get information
needed and funding cmit~nts ~ade; then ~e can deterMne
whether staff can authorize the ~ork, or if it is necessary
to seek City Council approval, etc.
2)
I have requested the project engineers to respond to this
request regarding resources need and When the funding
obligation can he determined.
AB0 Development financial obligations regarding this
request must he assured before change orders can he issued
and/or ~ork orders given. Please seek Frank Trando's, City
of Coppell Finance Director, advise and consent un various
options available, so that he can approve the expenditure
of funds wh~n needed, etc.
Please provide ~e with the develolment plans (plan vie~s, etc.) that
are approved or proposed to he approved by the City of Coppell, that
will be serviced by these ~edian Cuts. Your drawings no doubt serve
for the engineering end construction purposes, but I need to kno~ the
planning established related to these ~dian Cuts, and you need to
furnish the~ to me for revime, verification or other con_~iderations.

Re: Denton Tap Road Improvements - ABQ Development's request for
Median Opening north of Parkway Blvd.
Dear Mr. Parche':
This letter is in response to your letter of November 3, 1988,
regarding the median opening you are requesting north of Parkway
Blvd. This median can be added to the Denton Tap Road
Improvements project by Change Order in accordance with
following:
ABQ Development Corporation must provide a letter of
Financial Commitment stating that they will pay for the
Engineering, Testing, Inspection, and Construction of
the requested Median Opening. This letter shall also
state that ABQ Development will deposit the funds with
the City of Coppell within five (5) days after the City
Council approval of a Change Order to the Denton Tap
Road Improvements Contract covering the construction of
the Median Opening.
Upon receipt of the above mentioned ketter of Financial
Commitment, the City of Coppell will authorize Ginn,
Inc. to prepare a Change Order to the Denton Tap Road
Improvements Contract and make the necessary plan
revisions to cover the addition of the subject median
opening.
I have enclosed a cost estimate for the Change Order and the
additional Engineering, Testing, Inspection costs. Please feel
free to call me if you have any questions.

Deer Russell:
While on a visit to the City of Coppe11 municipal building on
December 21, 1988, I noted that the subgrade on the west side of
Denton Tap Road had been recently shaped and graded. It appears
that paving construction is eminent.
On November 3 and November 30, 1988, I sent letters to you on
behalf of ABQ Development Corporation requesting that the City of
Coppell include median openings in Denton Tap Road adjacent to
ABQ's property in the current roadway improvement project. On
November 16, 1988, you provided me a draft copy of the City's
response to my November 3 letter, however, I have not yet
received an executed response.
Please provide confirmation that the median openings are
acceptable as proposed as soon as possible and advise me of the
City's requirements in order that these median openings can be
constructed with other paving in this project. Thank you.
