Item #18 CITY COUNCIL AGENDA DATED: April 12, 1988 II. COMMENTS/RECOMMENDATION: As indicated in the letter from John Karlsruhrer from Ginn, Inc., we are tabulating bids on Denton Tap and have now determined the amount of funds which will be required from Dallas County to complete the Denton Tap Road project. Based on the schedule indicated and pursuant to Dallas County approval of this request we will be submitting our recommendation for award of contract for the project at your April 26th meeting. DENTON TAP ROAD IMPROVEMENTS - PROJECT SCHEDULES As you are aware, we opened bids for the two projects on March 3, 1988. Since that time we have been analyzing and tabulating the bids recieved and have conducted a review of the apparent low bids with the apparent low bidder. At this time we are awaiting submission by the low bidder of his qualification documentation and checking some of his references in preparation of drafting a recommendation of award of the Contracts for the City Council's consideration at the April 26, 1988 City Council meeting. We have developed the following schedule in anticipation of the above: April 12, 1988. The City Council should consider a resolution requesting that Dallas County provide $ 2.6 MM in funding from the 1985 Bond Program and authorizing the Mayor to execute a Supplemental City/County Agreement providing for such. 2 o April 18, 1988. The Dallas County Commissioner's Court should consider the City of Coppell's request for partial funding of the Denton Tap Road Improvements and approve a Court Order allowing the County Judge to execute a Supplemental City/County Agreement for provision of the $ 2.6 MM in Bond Funds. April 26, 1988. City Council consider recommendation by Ginn, Inc. for the Award of the Contracts. (This is dependant upon whether or not the above mentioned Court Order is approved.) 4 o April 26, 1988 through mid May 1988. Pursuant to award of the Contracts, the Contracts must be executed, Bonds furnished, pre-construction meetings conducted, and Notices to Proceed issued. Mid to ].ate May 1988. Begin construction of both projects. 6. Mid to late May 1989. Both projects should be complete. In light of the number of entities and amount of work involved,' the above Schedule is the most optimistic that we can reasonably hope to achieve in getting the two projects under construction. WHEREAS, the City of Coppell has approved a Capital Improvement Project to improve Denton Tap Road from Belt Line Road to Sandy Lake Road; and from Sandy lake Road to Denton Creek, and WHEREAS, the City of Coppell is now proceeding with the construction of Denton Tap Road from Belt Line Road to Sandy Lake Road; and from Sandy Lake Road to Denton Creek, and WHEREAS, the City of Coppell desires financial assistance for the construction of Denton Tap Road from Belt Line Road to Sandy Lake Road; and from Sandy Lake Road to Denton Creek. NOW, THEREFORE, BE IT RESOLVED, that the city of Coppell hereby requests $2,600,000.00 in financial assistance under Proposition 2 of the 1985 Dallas County Bond Program for the construction of this much needed improvement and hereby authorizes the Mayor to execute a Supplemental Interlocal Agreement of that effect. APPROVED: Lou Duggan, Mayor ATTEST: Dorothy Timmons, City Secretary THE STATE OF TEXAS COUNTY OF DALLAS SUPPLEMENTAL CITY/COUNTY AGREEMENT WHEREAS, the City of Coppe11, Texas, hereinafter called "City" and the County of Dallas, hereinafter called "County" desire to enter into an agreement for the construction of paving, storm drainage, and bridge improvements in connection with the Denton Tap Road Project (Belt Line Road to Denton Creek) in the City of Coppell and the County of Dallas; and WHEREAS, the Interlocal Cooperation Act, Article 4413 (32c) Vernon's Annotated Civil Statutes, provides authorization for any local government to contract with one or more local governments to perform governmental functions and services under the terms of the Act; NOW, THEREFORE, THIS AGREEMENT is hereby made and entered into by City and County upon and for the mutual consideration stated herein: W I TN E S SETH : I. City hereby requests County to participate in the cost of paving, storm drainage, and bridge improvements as part of the Denton Tap Road Project pursuant to Proposition No. 2 of the 1985 Dallas County Bond Program. II. County hereby agrees to reimburse City for cost of construction of eligible paving, storm drainage and bridge improvements in accordance with plans and specifications approved by the County. III. City hereby agrees to be responsible for administration of the project and construction contract for the improvements. City will provide copies of all plans and specifications to County prior to the award of any contract for the construction. IV. County will provide funding in an amount not to exceed $2,600,000.00 for the construction of the improvements. City will submit invoices and supporting documentation to County for reimbursement, based upon a prorata percentage of the County's funding and the total construction contract amount of eligible items, as costs are incurred by City until such time as the project is completed or the County funding limit is reached. City will be responsible for all costs required to complete the project which are in excess of the authorized County funding. City will advise County during construction of all design changes. VI. The City further agrees to indemnify and save harmless County from any liability or damages County may suffer as a result of claims, demands, costs, or judgments against County arising out of the performance of the work and services under this agreement or arising from any accident, injury, or damage whatsoever, to any person or persons, or to the property of any person(s) or corporation(s) occurring during the performance of this agreement and on or about this project, except for any liability or damages caused by the negligence of employees. City hereby agrees the County, its agents, officers and/or VII. to credit County for any decrease in quantities of work upon completion and final acceptance of the work by City and return to County all funds provided to City but not used for construction of paving, storm drainage and bridge improvements under this agreement.
