Sandy Lake Road Water Line Connection
Dear Mr. Pafford:
The purpose of this letter is to verify the discussions and agreement between you and
Lynn Kadleck, my engineer on the referenced project, regarding the water line
connections between our subdivision and the line along Sandy Lake Road. As you know,
our original plans called for two connections to this line in order to provide a looped
system. At that time we were not certain that we would be able to acquire the 3.5 acre
tract immediately east of Fountain Park.
On August 31 we completed the acquisition of this 3.5 acre tract, and we are presently
in the process of zoning and platting the property for development as the connecting
piece between Fountain Park and our Water's Edge project located along MacArthur
Blvd. This will enable a looped water system and eliminate the need for one of the
connections to Sandy Lake Road.
It is my understanding that you are in agreement that we can eliminate the western water
line connection (located between Lots 4 and 5 of Block A) based upon our representation
that we will provide a connection to the tract to the east. It is also my understanding that
your agreement is contingent upon our inItiating construction activity on the adjacent tract
within six months of this letter. At such time, if we have not started construction or cannot
provide evidence that such construction is imminent, we will be required to make the
second connection to the Sandy Lake water line per the original plans.
