Line Road to Sandy
Pursuant to our telephone conversation of March 23, 1989, I
instructed Mr. Fleming, our project representative, to contact
the Contractor and request that he contact Mr. Greer and work out
a solution to Mr. Greer's concerns. My March 24, 1989 followup
on this contact indicated that the Contractor had not yet made
the contact so I instructed Mr. Fleming to continue pursuing this
matter with the Contractor.
At 9:30 PM on Saturday evening, March 25, 1989, City Councilman
Mark Wolfe called Mr. Ginn regarding complaints he had recieved
from Mr. Greet and the interruption of his business. Mr. Ginn
called the restaurant and spoke to the manager. The manager said
there was no problem and that business had been good all evening.
Mr. Ginn then returned Mr. Wolfe's call at 9:32 PM and reported
same. Mr. Wolfe thanked Mr. Ginn for his efforts.
On Monday, March 27, I attended the weekly project progress
meeting at the project trailer. Since you and I had discussed
this matter that morning, prior to my departure to the site, I
made a stop at the McDonalds to visually confirm the access.
There was no interruption of either of the existing driveways,
and no obvious barriers to visibility or access. At the project
meeting I stressed to the Contractor the importance of effective
communication with the property owners and the need to keep them
informed of changing situations as they occur. I suggested that
they set up a meeting with Mr. Greet as soon as possible and
allow us to attend.
The meeting was arranged for Wednesday morning, March 29, 1989,
at 10:00 AM at McDonalds. Very early in the meeting Mr. Greet
stated that he was unaware of any reason for Ginn, Inc. to be
involved, as he and the Contractor had reached agreement the week
before as to the provision of temporary access to his business
during paving construction at that location. He mentioned that
he had discussed his situation with some of the City Councilmen,
but was not complaining or trying to get any specific action.

Our meeting with Mr. Greer and the Contractor gave us the
opportunity to listen and comment on the Contractor's proposed
temporary access. The result of the meeting is that the
restaurant will have a temporary two way asphalt driveway
constructed at its southern property line which will allow both
entrance and egress for north and south bound traffic; and the
existing concrete alley at the rear of the property which
connects to Sandy Lake Road will be used as an alternate access.
The Contractor will furnish slgnage to direct customers to these
access points. A proposed driveway to Denton Tap Road located at
the north property, line was eliminated from consideration due to
the short distance from the Sandy Lake/Denton Tap intersection to
the temporary detour across the median. This would create a
safety hazard to traffic southbound from the intersection.
Preparation of signage is planned to begin immediately, with the
driveway construction, signage, and barrier adjustments on about
April 10, 1989. It is anticipated that the paving of both
McDonalds permanent driveways as well as the roadway in front of
McDonalds will take two weeks barring weather or other delays.
We want to emphasize that this agreement exists between the
property owner and the Contractor and that Ginn, Inc. and the
City of Coppell are not obligated in any way or fashion.
Mr. Greet also requested that a press release be sent to the
newspaper and the Cable Television network announcing the
alternate access. We will leave it to your discretion to respond
to this.
It appears that the situation is now stable.
In regard to Mr. Fuller's complaints, you will recall that the
Engineering, Public Works, Fire and the Police Departments were
present in a meeting at Coppell Town Center on T~esday, March 7,
1989, when the Contractor presented his traffic plan which
temporarily routed traffic onto Oak Crest Street. It came to my
attention this past Monday morning, prior to the project progress
meeting, that Lt. Leonard and Vivyon Bowman met our
representative at our field office on Friday afternoon, April
24, 1989, in response to the attached complaint. They moved
barricades placed by the Contractor and erected them in another
location. This placed the City in full and sole responsibility
for any damages, losses, etc. resulting from any accidents
arising out of the traffic control and routing situation at the
time.
This all occurred at a time when all project personnel were
available for consultation prior to taking any action. All
departments have our listing of emergency telephone numbers, with
which someone in authority may be reached at any time. We highly
recommend that they use these numbers. In the future it would be
appropriate for the City to contact our office in these
situations and allow us to investigate the situation and
recommend the appropriate action before undertaking the moving of
any barricades or traffic control devices.
Our attempts to contact Mr. Fuller by telephone have
date. We shall continue to try to contact him.
