The attached letter from Wayne Ginn's office provides you with some understanding as to what has taken place in obtaining right-of-way in construction of Denton Tap. I would suggest that staff present a detailed review at the time we initiate our assessment program of which you will certainly be informed and a participant thereto. We could begin the assessment program at any time, but due to current staff limitations and work load, we have not been able to formalize a presentation to you. We also need to schedule completion of the assessment program related to Beltline north/south from 635 to the railroad tracks. In the last couple of weeks staff has met with George Schrader and Larry Jackson to discuss how and when we should proceed. We are still attempting to complete this project and Larry has provided us with a "workbook" which provides a step-by-step outline and should assist staff with both of these projects. We believe this document will be a great asset and "boom" to all of our understanding as to the exact process of the assessment program and how it should be undertaken and accomplished. Please let us know if you feel staff should have additional meetings with the Fikes. It appears from John Karlsruher's memo that there have been several meetings and discussions with the Fikes prior to this time. Please let us know if we can assist. Dear Mr. Doyle: As requested in our telephone conversation of last week, I am writing this letter to give you the facts concerning the status of the Denton Tap Road Right-Of-Way width with respect to the North Lake Nursery owned by Mr. Joe Bob Fikes. This project is designed as a Principal Arterial (P6D) in accordance the provisions of the Major Thoroughfare Plan and Subdivision Ordinance in use at the time that the project was authorized. As such a 120 foot wide Right-Of-Way was required for the roadway. At the time that the design of the project was begun there were several places along the road in which the_ex__%s~ting R.O.W. width was 0~%~ 100 feet. Mr. Fikes' property is one of these locat~ns. 'with inadeqt/~.O.W. ' Since a large portion of the frontage of Denton Tap Road was undeveloped at the time that design was started it was decided to design the road to its full capacity and work with the adjacent landowners to acquire the necessary R.O.W. by dedication as the properties came in for platting ~f the property owners would grant temporary_ construction ~as~gn~s and any permanent easements necessary to'build the road. This would allow for the complete construction of the roadway, and give the adjacent property owners some relief in this poor Real Estate market and local economy. This approach to the insufficient R.O.W. has been presented at both property owner meetings, February 16, and December 17, 1987, and one CBA luncheon, and has been, totally embraced by the property owners. Mr. Fikes has been cooperative from the beginning in granting the necessary temporary construction easements, copies which are on file both here and in your offices. In all of our dealings with property owners and businesses adjacent to Denton Tap Road we have stressed that in accordance with the Thoroughfare Plan and the Subdivision Ordinance of the City of Coppell, they will be required to dedicate additional R.O.W. at the time of platting. To this effect we transmitted marked drawings indicating the properties which have insufficient R.O.W. to Mrs. Taryon Bowman on May 4, 1988. 17103 Preston Road · Suite 100 · LB 118 · Dallas, Texas 75248 · Phone 214/248-4900 On several occasions Mr. Fikes has made it clear to us that he does not intend to dedicate any additional R.O.W. for Denton Tap Road. He has stated that his intentions are to have the City of Coppell pay him for the additional R.O.W. that is needed. Recently, Mrs. Fikes has stated her intent to prevent the Contractor from using the temporary construction easement which has already been granted to the City of Coppetl. As you are already aware we are currently trying to coordinate a common driveway and median opening with Mr. Fikes and his neighbor to the north, Mr. Bill Thompson. The location and size of this driveway is yet to be determined by the property owners and accepted by the City of Coppell. We are awaiting their revised plans. Dear Mr. Godwin: In our two previous property owner meetings held at Coppell Town Center on February 16 and December 17, 1987 concerning the above project we discussed the need for additional Right-Of-Way along your property in order to properly construct and maintain the proposed Road Improvements. The additional Right-Of-Way needed amounts to a 10 foot wide strip along the front of your property. In consideration of the current economic situation in our area the City of Coppell requests that you dedicate a 10 foot Temporary Construction Easement, two copies attached, now in order to allow construction of the project to begin about June 1, 1988. The permanent 10 foot R.O.W. dedication will be made a requirement for approval of any future platting or development of the property and can be handled at the appropriate time. If you agree to the above, please execute both copies and return one to our office. The ownership and recording data shown on the Easement is based on the best information available to us at the time that the project was surveyed, but appears to be out of date. In the case that the aforementioned data is incorrect, please line through it on the documents and insert and initial the corrections. Upon completion of construction of the project we will return our copy to you. Please feel free to call me if you have any questions concerning- the project.
