Director of Public Works Dallas County 411 Elm Street Dallas, Texas 75202 Re: Sandy Lake Road Project 91-838 (City of Coppell Project ST 93-01a) Dear Mr. Beene: This letter is written as a follow-up to our various conversations concerning the right-of-way associated with this project. After numerous meetings with Mr. Harrington, the City has been unable to negotiate the easement necessary to construct the project. While Mr. Harrington has been amenable to discuss the issue, he has been unable to provide direction to the City such as: is this a financial issue, visibility issue, damage issue, additional dollars, additional access issue, etc. Because we have been unable to ascertain what Mr. Harrington is seeking, the City of Coppell has informed him that we will be following the process of eminent domain to acquire the necessary right-of-way. To that extent, the City of Coppell requests that the final right-of- way documents be prepared and provided to the City so that our appraiser can begin. Our attorney has informed us it will take approximately 90 days to get through the process of eminent domain. As we have discussed in previous meetings, prior to the final right-of-way documents bring provided to the City, there needs to be additional research on the area labeled as "acquired by prescriptive rights". The City asks that this be thoroughly researched so that it does not become a stumbling block during eminent domain hearings for this property. Additionally, the City of Coppell will begin immediate negotiations with the Farrells concerning the acquisition of their requested right-of-way. A short timefuse will be allowed for those negotiations and if no progress is made then the process of eminent domain will also be started on that property. You have previously asked if we objected to Dallas County contacting both TU Electric and Carrollton Farmers Branch School District in an attempt to acquire the necessary right-of-way from those two entities. You stated that initial contact had been made and response was positive. The City of Coppell offers no objections to Dallas County preceding with the acquisition of the right-of-way from those two entities. However, if any commitments are necessary to those entities on behalf of the City of Coppell, we respectfully request that we be included in those negotiations. As an additional note, I have reviewed a letter from David Howard, dated January 5, 1996 to Dallas County concerning drainage associated with Sandy Lake Road Project 91-830 (City of Coppell Project ST 93-01). The City of Coppell provided to Mr. Howard and Dallas County information from the Eagle Point Subdivision which showed approximately 15 acres of land draining to Sandy Lake Road to be picked up with the Sandy Lake Road Project. The City had instructed Johnny Thompson to contact the County to ascertain if it was possible to drain to Sandy Lake Road. As of this date, the City of Coppell has not received any revised drainage plans. In reading Mr. Howard's letter, it appears as though approximately 6 acres i.e. the retail site, along Sandy Lake Road could drain into Sandy Lake Road. Because the City of Coppell has not had the benefit of reviewing the drainage area map or the revised drainage plan, we are unable to comment as to whether or not this is adequate. The City is also puzzled by the fact that while we provided drainage plans from Eagle Point those drainage plans have not been incorporated into the design of Sandy Lake Road and as of yet the City has received no explanation of why the proposed drainage design has not been incorporated into Sandy Lake Road. Prior to the City of Coppell approving the drainage design, it's our opinion that it would be only appropriate to review the revised drainage design for Sandy Lake Road. Obviously, this drainage design impacts the bridge design. The City of Coppell would be happy to discuss this with you at your convenience or at one of our scheduled meetings. Sincerely, Kenneth M.
