Dear Mr. Cook:
As you are aware, a dra/nage channel currently traverses the site
along the Thweatt Road frontage. Several d/scussions have taken
place between City a~aff and repreaentat/vea of your firm, in order
to review opt~ons regarding the required improvements to th~s
channel as a result of the development of the site. Based on these
discussions, the City wou/d be receptive to the possibility of
al/owing the channel to remain open un~%l Thweatt Road is improved
as long as the following cond/tions are met:
1. The owner accepts the responsibility of maintenance of
the channel;
The development of the site, in conjunct_ion with the
channel rema/n/ng in its current open condi~/on, does not
create a detrimental effect on ~he proper~.iea adjacent to
the site.
In addition, this condition would have to be acceptable to the City
Council.
