Sandy Lake and Lodge Roads Dear Mr. Frase: Mr. Martin, District President, has asked me to respond to the copy of your letter to Mr. Goram of the City of Coppell regarding utilities to the referenced land. The subject land is not within the boundaries of the District. In order for the District to consider providing utilities to the land, the legal owner of the land must file a Petition for Annexation with the District together with the required ancillary information. If the District determines that existing facilities are sufficient to serve the tract and that it can be served without injury to other lands now in the District and that it is feasible to serve the land, then it will request the City's consent to annex the land. If the City grants its consent, then the land can be annexed, subject to payment of the Annexation Fee and a determination that all facilities meet the design criteria of the District. I believe you are aware that the District's program for allowing developers the opportunity to earnback a portion of the utilty and drainage costs will terminate September 30, 1990. Consequently, unless there is some change the District will not offer you an earnback agreement on the subject land. If you have any questions, please advise. Yours very truly, PWP:bs Paul W.
