4.3.7 A new section of 4-foot sidewalk will be constructed in order to tie the proposed curb ramps
into the existing 4-foot sidewalk. The nonconforming condition may occur in the location
where the proposed sidewalk ties into the existing sidewalk. The existing sidewalk may have
a nonconforming cross slope.

The design of the project has not been started - the Community Block Development Grant funds are
a~vailable in October 2006. The city is waiting to see if the variance is approved before starting the design. __

The City of Col>oell al>olied for and received a Community Development Block Grant (CDBG) in the amount
of $72,379.68 for the Samuel Boulevard Curb Ramp Project. The proposed proiect consists of the
reconstruction of 26 curb ramps along the west side of Samuel Boulevard, from Parkway Boulevard to
MacArthur Boulevard. The existing ramps at the seven intersecting streets and the six intersecting alleys are
not compliant with the Texas Accessibility Standards (TAS). Samuel Boulevard is a major thoroughfare within
the city and providing TAS compliant ramps along this thoroughfare will benefit the entire city as well as
surrounding residents. This section of sidewalk is adjacent to five subdivisions that have ingress and egress off
of Samuel Boulevard. Elementary school age children from these subdivisions attend Lee Elementary School
and this sidewalk provides pedestrian access to the school. This sidewalk also provides pedestrian access to
nearby churches and city park facilities.
The proposed curb ramps are within City of Coppell public right-of-way. In accordance with 16 TEX. ADMIN.
CODE §68.102, the application of TAS shall be limited to those pedestrian elements being constructed,
renovated, modified, or altered as part of the project scope. The city does not intend to reconstruct any non-
compliant crosswalks or sidewalks that are within the right-of-way of the project limits as part of this project.
The city is requesting a variance on TAS Section 4.3.7, cross slope of an accessible route. A new section of 4-
foot sidewalk will have to be constructed in order to tie the proposed curb ramps into the existing 4-foot
sidewalk. The cross slope on the existing 4-foot sidewalk varies and may or may not be compliant. If the city
is not allowed to tie the new sidewalk in at the cross slope on the existing sidewalk and is required to hold the
cross slope on the new sidewalk at 1:50, large sections of the existing sidewalk may have to be removed and
replaced.
The city is requesting the variance prior to initiating design of the project. It is unknown at this time how many
linear feet of the existing sidewalk, if any, would have to be removed and replaced. Compliance with TAS
Section 4.3.7 is impractical on this project for the following reasons:
1. The city has CDBG funds in the amount of $72,379.68 for the project and the estimated cost for design and
construction of the 26 ramps is $72,205.00. Them is not additional funding available for the project if the
scope is increased by having to remove and replace sections of the existing sidewalk. The cost estimate for
the project is attached.
The estimated cost to remove and replace sidewalk is $75.00 a square yard. There is approximately 1600
linear feet of sidewalk along Samuel Boulevard (Parkway Boulevard to north of Hood Drive) and there are
seven intersecting streets with sidewalk on each side. Removine and revlacine just 500 linear feet of
sidewalk would increase the cost of the project approximately $21,000.00 (500 x 5' wide sidewalk = 2500/9
278 S.Y. x $75.00 = $20,833.00).
The existing sidewalks are 4-foot wide without available passing spaces. New sidewalks will have to
comply with TAS Section 4.3.4. The existing right-of-way along Samuel Boulevard is 7.5 feet wide and is
not wide enough to have a 5-foot wide sidewalk or passing space, franchise utilities, public utilities and a
grassed strip between the sidewalk and roadway.
The homes along the intersecting streets have established grass, landscaping, and fencing. Replacing large
sections of sidewalk in front of these homes has the potential to damage these amenities and would be an
inconvenience to the homeowners and an additional cost to the city.
