Release of Maintenance Bonds and
Agreement of Indemnity
City of Coppell , ("Obliges"), as obliges on those certain
maintenance bonds (the "Bonds"), numbered 4349481 , on which SureTec
Insurance Company ("SureTec") is surety, and Enaineered Retaining3 Well Systems
("Principal") is principal, hereby requests the cancellation of the Bonds and the return of
any unearned premium to Principal. In order to induce Surety to return any unearned
premium, Obliges wac'ants, represents, and agrees with Surety end Principal as follows:
1. Obliges fully, finally, and forever releases the Bonds and all rights thereon,
whether known or unknown) and agrees that the Bonds shall be considered void ab in#lo
and of no force and effect.
2. Obliges warrants and represents that Obliges has not represented to any third
party that the Bonds were issued end has not furnished copies of the Bonds to any
person or entity. Obliges has returned the original Bonds and destroyed all copies of the
Bonds in existence.
3. Obliges warrants and represents that no work has commenced by Principal
under the contract covered by the Bonds.
4. Obligee agrees to indemnify, defend, and hold Surety harmless from and against
any and all claims, losses, demands, expense (including attorney's fees) made or that
may hereafter be made by any person or entity against Surety In connection with, or as
the result of the Sursty's original execution of, the Bonds.
5. The obligations of Obliges hereunder are due, payable, and performable at the
home office of Surety in Houston, Harris County, Texas.
6. Obliges understands and agrees that Surety is relying upon the representations
made herein, and the obligations and promises of Obliges undertaken herein, in
returning premium or taking other actions in connection with Principal's bond relationship
with Surety in direct reliance thereon.
