Shady Grove Road Irving, TX 75060 NOTICE TO PROCEED WITH CONSTRUCTION RE: Belt Line / Denton Tap 16-Inch Water Line Project #WA 97-01 Dear Ms. Childers: This letter will serve as your official notice to begin work on the referenced project. For purposes of the contract, your calendar days will start November 14, 2005. If you should begin work prior to that date, then the calendar days will commence on the day work begins. One hundred fifty (150) calendar days were bid on this project for completion of work. Therefore, if work begins on November 14, 2005 then the calendar days on the project will expire on April 12, 2006. In the preconstruction meeting we discussed the fact that the City of Coppell is interested in an expedient completion of this project because of the impact to traffic along Denton Tap Road and Belt Line Road. Therefore, Council has authorized up to a $30,000 bonus as an incentive to complete this project early. Our goal would be to have this project completed within 120 calendar days. That would be March 13, 2006. If the project is completed on or before March 13, 2006 then you would be entitled to a $30,000 bonus. For every day you work beyond March 13, 2006 up to April 12, 2006, the bonus amount would decrease by $1,000/per day. Therefore, if you complete the project on April 11, 2006, you would only be entitled to a $1,000 bonus. Also, for every day that the project goes beyond April 12, 2006, you will be asgessed $240 as liquidated damages. In the preconstruction meeting, it was noted that the bonus will only be awarded upon 'complete completion of the project', not on substantial completion. 'Complete completion' means the project is finished and accepted by the City. This includes any punch list items, irrigation items, landscape items, or other items associated with the total completion of this project. The City of Coppell looks forward to working with you on this project, hopefully to a successful completion in which you are able to obtain the entire bonus that the City is offering for the early completion of this project. If you have any questions concerning the early completion incentive bonus, please feel free to contact me. If you have any questions or need any additional information concerning the project please feel free to contact Rick O'Dell, Construction Inspector at (972) 304-7090. Sincerely, Kenneth M.
