Box 540787 Dallas, TX 75354-0787 Re: Sandy Lake Road Project # ST 93-02 Dear Mr. Weber: This letter is written in response to your March 23, 1999 letter concerning price adjustments for lowering 8", 10" & 12" water lines in conflict with the proposed construction along Sandy Lake Road. During our telephone conversation of March 24, 1999, I indicated that upon my review of the plans and specificadons it was my determination that the lowering of 8" water lines should be handled under Pay Item #89 and the lowering of 12" water lines should be handled under Pay Item #88. If we do encounter any 10" water lines we would pay for them at the same price as the 12" water line, which is $48/per linear foot. Your letter makes the point that it was anticipated that all the lowerings would be approximately 45-feet in length. However, the plans show only 3 lowerings of the 12" water line: 1) Sta. 68+15 - 10 feet, 2) Sta. 56+20 - 16 feet, 3) Sra. 55+08 10 feet. All those lowerings have fittings associated with them plus blocking, etc. The description of Pay Item #88 and #89 specifically states that the price per foot includes all fittings, restraining joints, blocking, dewatering, excavation, backfilling, disposal of existing materials, etc. It should be anticipated on a project of this magnitude and length that there will be conflicts with existing utilities during the course of construction. It is very difficult to ascertain the exact elevation of underground utilities during the design of a project. If you were unclear on how you would be compensated for conflicts with exisdng utilities encountered during the course of construction, that should have been brought to the attention of the City prior to submitting a bid on the project. Section 6 of the bidding document states that it is the bidders responsibility to carefully examine the contract documents, study and carefully correlate observations with the contract documents and notify the engineer of any conflicts, errors or discrepancies in the contract documents. It has always been the design engineer's understanding and the City's understanding that the aforementioned Bid Items #88 and #89 were meant to cover any conflicts encountered during the construction of the project. Your request for additional compensation per foot for the 8" water lines encountered at Fountain View and Meadowglen, the 10" water line encountered at Mapleleaf, the 12" water line encountered at Heartz and any other water lines that may be encountered during the course of construction is not approved. Again, all water line adjustments associated with those conflicts will be paid under Bid Items #88 and #89. The City is requesting that work on the project continue without delay and that any water lines encountered be lowered and put back in service with payment under Bid Item #88 or #89. For reasons of clarity, we would prefer to be paid for this work utilizing a lump sum pay item. It is our understanding that a similar adjustment is necessary for an existing 12" water line and may become necessary for a 10" water line. Additionally, it is apparent that multiple adjustments will be required and that pre-approved prices for this type of work will minimize delays to the project. Based upon a similar analysis, our prices for 10" and 12" water line adjustments are as follows: 10" water line adjustment $2,465.00 per location 12" water line adjustment $2,630.00 per location Please add an additional two calendar days to the project's duration for each water line lowering.
