OFF-SITE DRAINAGE RESPONSIBILITY - CATELLUS PROPERTY

It is my understanding that a question was asked by Council (after Ken
Griffin's briefing regarding a potential drainage issue involving the
Catellus property}, which related to the City's responsibility to provide
off-site draina§e improvements to development projects; specifically, was
there any written agreement between the City and Catellus to provide their
off-site improvements?
Last fall I attended a meeting with Shohre, Wayland Threadgill and Pat
Acker when a similar question came up. It was my opinion at that time
that the City had no obligation to resolve the drainage problem, there was
no written agreement that I was aware of, and that Catellus should be
talking to Prentiss Properties to see if mutually the two developers could
address that issue. In correspondence subsequent to that meeting, Mr.
Threadgill drafted a memo to Mr. Weldon Davis basically reiterating my
position. A copy of that memorandum was included in the Council back-up
last week.
So, in a word, no, I am not aware of any written agreement which mandates
the City providing off-site drainage improvements for the Catellus
proposal. Over the long-term, of course, the way cities traditionally
deal with upgrading infrastructure is through capital improvement programs
and bond issues.
