Gateway Business Park/Waterline Refund Request
As requested by Steve Goram, Director of Public Works, please find
the attached draft copy of a letter addressed to Mr. Pat Acker in
response to his request for 16" waterline reimbursement. As you
may recall, we discussed this matter at a meeting on January 10,
1991.
Please provide your comments as soon as possible, or no later than
February 20, 1991. We appreciate your timely attention.

Attached please find a draft copy of a response letter, that I have
prepared for your signature, on the above referenced request by Pat
Acker of Albert Halff & Associates.
Please note that Pat Acker has been awaiting our response for some
time. As you know, we discussed this issue with Larry Jackson,
City Attorney, on January 10, 1991. He suggested that we respond
according to our findings and review.

16" Waterline Reimbursement
Dear Mr. Acker:
This letter is in response to your request of reimbursement for the 16-inch
waterline installed along Oateway Boulevard West, a distance of 2,663 feet
ending approximately 850 feet east of Royal Lane.
Based on a detailed review by affected City Staff and the City's consultant
engineer, Ginn & Case, Inc., formerly known as Ginn, Inc., and since the
subject final plat was approved prior to the effective date of the Impact Fee
Ordinance %90478, such reimbursement is subject to the 1985 Subdivision
Ordinance Provisions.
As per the 1985 Subdivision Ordinance, Appendix B, Pages 7 and 8, ...the
increment of cost borne by the City shall be determined on the basis of the
difference between the unit prices established.., for 10-inch waterline and
larger..., in this ordinance. Therefore, the reimbursable amount for the 16-
inch waterline ($7.00) per linear foot is $18,641.00.
Should you desire to request a reimbursement and/or credit in the amount of
$18,641.00, please provide a formal request in this regard. It will then be
placed on the next available City Council agenda for consideration.
