Subject: Hager Containers Addition
We have reviewed the preliminary/final plat and construction
plans for the above referenced project.
Per the sub-division ordinance and master thoroughfare plan,
Royal Lane is classified as a major thoroughfare and thus
requires a 110' right-of-way. A 100' right-of-way currently
exists. As a result, the staff has requested an additional 5' of
right-of-way to be dedicated along the frontage. This request
will be made to all properties fronting Royal Lane as each
property goes through the platting process.
For your information, the reason the city requires 110' of right-
of-way vs. 100' is to allow adequate width in the parkways for
city utilities, other public utilities, sidewalks and landscape
and irrigation. Experience has shown that this additional 5'
greatly reduces the chance or need to ,'stack" utilities, etc. due
to parkway width restrictions-

Attached is a copy of the two packets for the preliminary and final
plats of the Hager Container Addition.
Please respond by September 1, 1988 to Taryon Bowman providing your
individual recommendations regarding the requested Variance ~2 and
Variance ~4, regarding water and sewer availability fees and the waiver
thereof, etc.
Should staff recommend one way or the other, the change in calculating
fees (variance ~2), reducing the yield of the fee regarding any finan-
cial ramification (e.g. water and sewer rates determination and their
dependency on fees collected, etc.), as well as any legal ramification
since, as I understand, we are being challenged in the courts regarding
fees of the past.
If you have any questions, please do not hesitate calling either Taryon

R.O.W. Recommendation and Results on the Hager Plats
Attached is the recommendation Ginn, Inc. gave on subject plat.. Kevin
did a very good Job, and he and I discussed the matter at great length.
While he may have provided appropriate responses, I am concerned for the
integrity of the future and maintenance of the City's Transportation and
Street Plans (Subdivision Ordinance, etc.).
Specifically, if we have only ten (10) feet of Parkway and five (5) foot
easement, will that confine us to a condition that is undesirable~
That is, when there are inlets and/or fire hydrants, et al in the
parkway, will the pavement be protected from cutting by having enough
R.O.W. for the utilities (theirs and ours)? Or will we sometime in the
future on these narrower R.O.W.'s, have to let utilities occupy either
the medians or the corridor under our pavements? Also note when Cities
build right turn lanes, sometimes additional R.O.W. is needed at a
higher cost than when platting, etc.
If your consideration would produce anything other than what has trans-
pired to-date, then written comments should be forwarded to Taryon
Bowman on or before September 1, 1988, so that it will be timely for
advise to the City Council on the Hager Plats. Thank you.

Following discussion, Commissioner Weaver moved to approve
Case #S-1034 with all variances. Commissioner Thomas seconded
the motion; motion carried (6-0) with Chairman Munsch and
Commissioners Green, Johnson, Thomas, Tunnell and Weaver
voting in favor of the motion.
PLATTING
Item 10:
To consider approval of a preliminary plat for Hater Container
Addition, located approximately 1,000 feet from the southeast
corner of Royal Lane and Thweatt Road, at the request of Hater
Containers.
Taryon Bowman introduced the item to the Commission.
Mr. Bill Anderson of Roberts and Dowdy Engineers was present
to represent this item. Mr. Anderson stated that he is
representing the owner of the property, Connell Development.
Following discussion, Commissioner Green moved to approve the
preliminary plat for the Hager Addition with variances three
(3) and five (5) included, with a recommendation to the City
Council that further input from City staff be considered for
variances one (1), two (2) and four (4), as stated on the
Staff Report of August 18, 1988.
Item 11:
To consider approval of a final plat for Hager Container
Addition, located approximately 1,000 feet from the southeast
corner of Royal Lane and Thweatt Road, at the request of Hager
Containers.
Taryon Bowman introduced the item to the Commission. Mrs.
Bowman stated that if this final plat is approved, staff would
request that it be stated with the stipulation that the
construction plans be approved by the City Engineer.
Again, Mr. Bill Anderson was present to represent this item.
Following discussion, Commissioner Tunnell moved to approve
the final plat for the Hager Container Addition with variances
three (3) and five (5); and that variance one (1) be worked
out to the satisfaction of the City staff. Commissioner
Weaver seconded the motion; motion carried (6-1) with Chairman
Munsch and Commissioners Green, Johnson, Thomas, Tunnell and
Weaver voting in favor of the motion.
Item 12:
Discussion of re-appointment of Board Members.
Chairman Munsch stated that all Board Members who are up for
re-appointment, and who are planning to re-apply, must submit
their applications to the City Secretary's Office by Monday,
September 19, 1988.

As you are aware, the way that the water and sewer availability fees
are caLcuLated is covered in section XVI (B) of our subdivision
ordinance. No distinction is made between office space versus total
building space. Therefore, the fee should be calculated on the total
square footage of the building.
Regarding the collection of the fees, I believe that they should be
collected in the manner specified under the subdivision ordinance.

Staff met with Bill Anderson, Engineer for Hager Containers, to discuss
the City's requirement for full flow meters on private fire lines.
After reviewing Mr. Anderson's proposal for 1 - 10" line for service
of closed and open fire protection at this site, staff was in agreement
with the proposed meter setting (DDC II).
The sprinkler system inside the building will be a closed system.
In the event water is used from the sprinkler system, an alarm will
sound at the Fire Station. All fire hydrants on site will be equipped
with Hydra-Storz connections at the expense of the developer. This
type of connection greatly restricts unauthorized use of fire hydrants.
