RE:
Request For Variances
Hager Container Addition
Coppell, Texas
Dear City Council:
On the request of Hager Containers, Inc., we are in the process of pre-
paring a plat of a 4.673 acre tract that is located approximately 1000
ft. east of S.H. 121 and 1000 ft. south of Thweatt Road (Sandy Lake Road)
along the east side of Royal Lane. Mr. Ted Hager has stated that he does
not plan to develop the tract immediately; but, he does plan to develop
within the next 2 to 6 years.
Due to the construction timing, to occur at a later date than the filing
of the final plat, we are requesting, on behalf of Mr. Hager and Mr. Mark
Connell, that the following variances to the subdivision ordinance be al-
lowed in conjunction with the approval of said plat.
Request that a full flow water meter not be required
on the water line that is to be used exclusively for
fire service requirements.
Request that the assessment for water and sewer fees
be limited to the office area of the building for
calculating associated fees.
Request that the requirements for landscaping, which
affect this tract, both conceptual and detailed, be
determined upon submittal of a Building Permit Request.
Request that the water and sewer availability fee be
assessed (100%) at the time of a Building Permit Request.
For fee calculations, we request that the area of "vari-
ance request No. 2" be used to determine the associated
cost.

Request that the dedication of an additional S ft. right-
of-way width, to the total 100 ft. right-of-way width,
be in the form of a S ft.' utility easement.

Platting Pro~ess and Fee Waiver Requests
Attached is a copy of the two packets for the preliminary and final
plats of the Hager Container Addition.
Please respond by September 1, 1988 to Taryon Bowman providing your
individual recommendations regarding the requested Variance #2 and
Variance #4, regarding water and sewer availability fees and the waiver
thereof, etc.
Should staff recommend one way or the other, the change in calculating
fees (variance #2), reducing the yield of the fee regarding any finan-
cial ramification (e.g. water and sewer rates determination and their
dependency on fees collected, etc.), as well as any legal ramification
since, as I understand, we are being challenged in the courts regarding
fees of the past.
If you have any questions, please do not hesitate calling either Taryon
or myself. Thank you.

R.O.W. Recommendation and Results on the Hager Plats
Attached is the recommendation Ginn, Inc. gave on subject plat. Kevin
did a very good Job, and he and I discussed the matter at great length.
While he may have provided appropriate responses, I am concerned for the
integrity of the future and maintenance of the City's Transportation and
Street Plans (Subdivision Ordinance, etc.).
Specifically, if we have only ten (10) feet of Parkway and five (5) foot
easement, will that confine us to a condition that is undesirable~
That is, when there are inlets and/or fire hydrants, et al in the
parkway, will the pavement be protected from cutting by having enough
R.O.W. for the utilities (theirs and ours)? Or will we sometime in the
future on these narrower R.O.W.'s, have to let utilities occupy either
the medians or the corridor under our pavements? Also note when Cities
build right turn lanes, sometimes additional R.O.W. is needed at a
higher cost than when platting, etc.
If your consideration would produce anything other than what has trans-
pired to-date, then written comments should be forwarded to Taryon
Bowman on or before September 1, 1988, so that it will be timely for
advise to the City Council on the Hager Plats. Thank you.

Hager Containers Addition
We have reviewed the preliminary/final plat and construction
plans for the above referenced project.
Per the sub-division ordinance and master thoroughfare plan,
Royal Lane is classified as a major thoroughfare and thus
requires a 110' right-of-way. A 100' right-of-way currently
exists. As a result, the staff has requested an additional 5' of
right-of-way to be dedicated along the frontage. This request
will be made to all properties fronting Royal Lane as each
property goes through the platting process.
For your information, the reason the city requires 110' of right-
of-way vs. 100' is to allow adequate width in the parkways for
city utilities, other public utilities, sidewalks and landscape
and irrigation. Experience has shown that this additional 5'
greatly reduces the chance or need to "stack" utilities, etc. due
to parkway width restrictions.
The other comment we have is in regards to the construction plans.
The fire lane is required per the sub-division ordinance to be 6"
cf concrete (3000 psi) on a 6" lime stabilized subgrade. The
s%aff does not support crushed stone as an acceptable alternative
to this requirement.

As you are aware, the way that the water and sewer availability fees
are calculated is covered in section XVI (B) of our subdivision
ordinance. No distinction is made between office space versus total
building space. Therefore, the fee should be calculated on the total
square footage of the building.
Regarding the collection of the fees, I believe that they should be
collected in the manner specified under the subdivision ordinance.

The sprinkler system inside the building will be a closed system.
In the event water is used from the sprinkler system, an alarm will
sound at the Fire Station. All fire hydrants on site will be equipped
with Hydra-Storz connections at the expense of the developer. This
type of connection greatly restricts unauthorized use of fire hydrants.

Hager Container Addition
Coppell, Texas
Dear City Council:
In addition to the variances requested, per letter August 3, 1988, on
behalf of Hager Containers, Inc. and Connell Development Company, we are
requesting that the following variance be added to those variances previ-
ously submitted.
Request that we be allowed to construct a main
building and accessory building not to exceed
98,000 square fe~, permitting B-2 occupancy,
Type lin construction, fully sprinklered, as
defined in the 1985 Edition Uniform Building
Code.
Please consider this variance in addition to those previously submitted.
If you have any questions regarding our request, please contact me.

Hager Containers, Inc.

Dallas, Texas 75234
Dear Mr. Hager:
Hager Containers has requested approval to construct a 98,000
square foot building with a sixty foot minimum setback from three
property lines. The proposed building would be set back twenty-
four feet from the north property line.
The building use has been determined to be a type B2 occupancy and
the proposed building is a type II-N structure. The building will
also contain an automatic sprinkler system. The structure will
consist of two floors. The first floor will have an area of 94,000
square feet while the second floor will be 4000 square feet.
In order for a building as described above to be constructed, there
must be a sixty foot setback from the building to all property
lines.
Mark Connell has proposed that a thirty-six foot easement be
dedicated parallel to the northern property line of Hager
Containers. The easement would be granted to effectively allow a
sixty foot setback on the northern side of the Hager Containers
property. As a result, however, thirty-six feet of property on the
south side of the land north of the Hager Containers property could
not be used in the calculation for building setback requirements.
The north portion of the easement would be considered as the
property line for development north of the Hager Containers tract.
The City of Coppell does not object to allowing the easement
alternative to be used in calculating building setback requirements
for the Hager Containers building.
