IMC (978)931-6787 ~.3 October 28, 2005 P It 0 P [ R T I [ $ Mr. Rick O'Dell City of Coppell 255 Parkway Boulevard Coppell, Texas 75019 RE: VILLAS AT LAKE VISTA Dear Mr. O'Dell, Per your specific request, this letter shah amend, and further clarify, information contained in my letter dated October 27, 2005 to you, regarding the timing and order of construction of the perimeter wall and sidewalk at the Villas at Lake Vista. It has always been our understan~ng from the City of Coppell that it made most sense to construct our masonry perimeter wall first, then the sidewalk. The logic being that the sidewalk is closer to the street and, therefore, might be subject to damage as the contractors building the wall would constantly be crossing the sidewalk to get to the wall. In the event you are in agreement with this, here is our anticipated timing: 1. File for wall perrmt - Status: This has already been filed with the City and we have not received our penmt as o f today. 2. Construct wall - We would begin the construction of the wall in the month of November, assuming timely receipt of our permit from the City. We would anticipate 3 to 4 weeks to complete the wall which would mean that we would be complete by mid to thc end of December. 3. Complete Sidewalk - Sidewalk construction would begin immediately al~er the wall is complete and should take no longer that 1 week to complete. Please note that these timing estimates contemplate "normal" circumstances. We cannot control adverse conditions due to.force majure, labor strikes, etc. Technically, the completion of the perimeter sidewalk is part of the "Civil" plans and needs to been done for City Acceptance, and the wall is not part of the plans. If the City does not agree with this order of construction, then we will gladly construct the sidewalk first, then the wall. 'We disagree with this order for the previously stated reason that the sidewalk could be. damaged. However, we need the City Acceptance letter as soon as possible. INC (972)931-6787 p.4 much, unfortunately, as I cannot convey title to the lots to the builder without the final City Acceptance letter. Again, it was our understanding in communicating with the City over the last several months that everyone was in agre~maent that it made most sense to do the wall first, then the sidewalk, in order to save tke:City possible repair dollars in the event that the sidewalk was damaged. If we m~sunderstood that, we apologize. Specifically, please let us know today if you require us to build the perimeter sidewalk before the perimeter wall m orde,' to receive the final City Acceptance letter. If we do not hear from you today, we will inu~acdiately beg~n construction of the sidewalk and will be complete by the end of next week, at which point we antic/pate the City to issue us a final City Acceptance letter.
