The applicant requests an additional median opening be designed and installed on the Denton Tap
Road C.LP. Project to accommodate an entrance to the Pl2n,ed Development approved with a
Preliminary Plat on July 14, 1987 (see attached Preliminary Site Plan, Sandy Lake Crossing).
Please refer to Ginn, Inc. letters (attached) dated March 27, 1989 and April 17, 1989 for
Staff's evaluation. Attached is a copy of the Exhibit submitted to Staff.
Since early March, when the applicant approached Staff with this request, the applicant does not
see any concern at all for the short distances that would result if this request is granted and
stressses it was previously approved by City Representatives (Gin,~ Inc. April 17, 1989 memo
addresses that matter).
The CityEngineer's letter of March 31, 1989 denied the request. However, the applicant
by April 10, 1989 letter (copy attached) formally requested a variance of the City Ordinance.
Various cerrespondence have beeen attached for background information.

We have been informed that the applicant has had an
independent traffic engineering firm conduct a study of the
requested median opening and the results of this study will
be presented at your Tuesday night meeting. Staff has not
had an opportunity to review the study, and if Council is
not convinced that the study addresses the safety concerns
which were considered when the ordinance for streets and
thoroughfares was adopted, we suggest that you table the
item until City staff has had an opportunity to review the
study.

Dear Mr. Doyle:
As per your written request of April 13, 1989, copy attached, we
have reviewed the variance request and have the following
comments:
As mentioned in previous correspondence, the Coppell
Subdivision Ordinance requires a minimum distance of 420
feet between median openings on major thoroughfares.
The median opening which is the subject of this variance
request is located approximately 242 feet south of the
one currently under construction as a part of the Denton
Tap Road Improvements Project.
The sketch submitted with the variance request
represents a left turn lane design which is not in
compliance with the Standard Construction Details of the
City of Coppell.
The proposed left turn lane is separated from the
northbound transition to the next standard left turn
lane and median opening by approximately 20 feet of
median curb. This close spacing of two left turn lanes
may lead to traffic accidents resulting from drivers
entering the first left turn lane by mistake and
attempting to immediately correct their mistakes by
jogging back to the right and into northbound traffic
without first signaling their intent and checking for
closely following traffic. We are opposed to allowing
two left turn lanes to be located this close together.
We do not recommend that the City of Coppell include the
construction of the proposed left turn lane as a part of
the Denton Tap Road Improvements project if the variance
should be approved by the City Council. We are not
prepared to assume any liability for injuries, deaths,
or damages arising out of accidents attributable to the
inclusion of the proposed left turn lane in the project;
and we do not believe that the City of Coppell is
either. Therefore, we recommend that if the variance is
approved, the developer be responsible for constructing
the left turn lane at his sole expense as a part of his
development project.

Dear Mr. Doyle:
Per our discussion this date, this letter is to formally request a variance of the city
ordinance restricting median cuts to a distance greater than the restricted left hand
turn median cut we have designed for the above mentioned project.
As I have stated in past correspondence, it is our client's desire to assume the cost
of construction for the installation of the median cut should the City find our re-
quest amenable. This cost is in addition to his previous agreements to share in the
cost of improvements of the southern half of Sandy Lake with Connell Develop-
ment.
In addition, I have included a preliminary sketch developed by Fdmley Horn Traffic
Design Engineers (along with a copy of the letter Jim Kurtz sent to your office in
February) that represents the configuration we desire. Further, I have again in-
cluded a copy of the meeting notes we have on record dealing with the median cut.
Unfortunately, I must admit the notes cannot be regarded as conclusive that a
determination was made in our favor. However, they do manage to demonstrate
that we were operating under the impression that we had received some form of
approval and the fact remains, the Preliminary Plat was approved by the City of
Coppell with the median cut shown in the configuration we need.

Howard Herrington opened the meeting with a brief summary of
events leading to today's meeting. Items covered included cur-
rent status with the anchor~ Albertsons~ and efforts to secur~
two or more junior anchors including possibly a health club.
Taryon opened the meeting to comments from staff:
General Telephone had no comments or problems.
Tim Bradshaw of TP~L indicated that the major feeder lines wou]J
need to circumvent the perimeter of the site to provide access t)
the out parcels. Service, wiI! be overhead. Dale Jackso~
reminded Mr. Bradshaw that the city has an ordinance thac
requires all new service to be underground. Mr. Bradshaw indi-
cated that TP~L installs only overhead unless the developer want~
to bear the difference in cost for underground. Mr. Jackson sai!
that he would follow up to confirm that the ordinance was CDr-
rect.
Fire: Requires a fire hydrant every 300' ordinance require;
24' firelanes - however~ Mr. Kurtz indicated that in previou~
discussions with the Fire Chief that 20~ was adequate if th.
building was sprinklered. '

Ginn. Bngineering Cabe Navre: Observed that the Plat will
requzre a complete survey description. Also, they did not
receive copies of the water and sanitary sewer plan. Jim Kurtz
indicated that the plans had been submitted but that he would
send additional copies. In addition, Mr. Favre observed that th~'
left turn only condition along Main was unacceptable. Mr. Kurtz:,
reminded him that in a previous meeting with Mr. Ginn, he had in-~
dicated that the condition was acceptable.;~ Mr, Favre will take:,
the matter up with Mr. Ginn. Howard reminded staff that both the
Owner of this tract and the C0nnell shopping center has expressed
a willingness to bear the cost for expansion of Sandy Lake which
should be taken into consideration. Also, Mr. Favre requested
that 30' and 50' radii be shown on the plans at all bends in the
firelanes.
Shohre Daneshuand asked that drainage improvements be coordinated
with the City - also, the culverts shown are actually $6", not
48". Mr. Kurtz observed that they are undersized in any event.
Steve Martin indicated that before development, the city would
require a traffic £1ow analysis dealing with access to the site.
Dale Jackson offered the observations:

Taryon Bowman requested that all existing zoning surrounding the

Per Our discussion at our meeting on February 16, 1989, I am submitting this letter and the
attached sketch concerning the preliminary design concept for a restricted left-turn lane on
northbound Denton Tap Road between the existing median opening at Braewood Drive and the
opening into Minyards/McDonalds. This design restricts median access to northbound left-
turns from Denton Tap Road, serving a planned future driveway located in the vicinity of
Station 157 + 60 (~:) on Denton Tap Road.
KimleyoHorn's transportation experts have reviewed the concept and determined that the median
access design provides the necessary ransmon and storage capacity to accommodate up to about
350 vehicles per hour, given unsignalized operations. Such unsignalizod operation permits safe
and efficient ingress from arterials, particularly where the median access is located in close
proximity (1,000 feet or less) to a signalized intersection, i.e. Denton Tap at Sandy Lake. The
adjacent traffic signal operation will effectively create adequate gaps in the traffic stream
hereby ingress chicles may safely negotiate the required turn maneuver.
Recommended standard design criteria for spacing of unsignalized access, published by the
Texas Transportation Institute, specifies a limiting distance of 250 feet separation for arterials
where the average running speed exceeds 35 mph. The proposed design satisfies this spacing
criteria. The other significant criteria is related to provision of adequate sight dislance for left-
turn vehicles for running speeds exceeding 35 mph. The proposed left-turn lane provides for
the necessary sight distance.

Re: Restricted Left Turn Access to Sandy Lake Crossing from
Denton Tap Road.
Dear Mr. Doyle:
We have reviewed the attached request and sketch for a proposed
left turn access to the subject property as requested. Basically
the left turn access proposed is prohibited in the Subdivision
Ordinanc~ and the Streetscape Plan.
The Subdivision Ordinance requires 420 feet between median
openings, measured from nose to nose, including 100 feet of full
width median for landscaping. The proposed left turn access
occurs in an area of the median 663.6 feet in length between
median openings. If constructed as shown, the distance between
median openings would be less than 420 feet.
The Streetscape Plan requires at least 100 feet of full width
median between openings for landscaping purposes also. This
request would eliminate all of the aforementioned median
landscaping between the Braewood Drive intersection on the south,
and the median opening and left turn lanes serving both sides of
Denton Tap Road at Minyard's main entrance on the north.
If the person making the request insists upon pursuing this
matter they must apply for variances to both the Subdivision
Ordinance and the Streetscape Plan as a part of their platting
efforts for the property. During that process they must show
just cause why their request has merit in light of the facts that
the property is: currently in a predominately undeveloped
condition; bounded on the east by Denton Tap Road, and the north
by Sandy lake Road with access to both; and is already proposed
to be served, along with 4evelope4 property on the east side of
Denton Road, with two median openings and left turn lanes along
its Denton Tap Road frontage.
If a request for the abovementioned variances is considered, it
must contain the provision that the property owner making the
request enter into a commitment with the City of Coppelt to
provide funding sufficient to offset the City of Coppell's costs
of Engineering, Testing and Inspection, and Construction prior to
construction of the requested restricted left turn access.

Enclosed please find a copy of the letter sent to you by Jim Kurtz of Kimley Horn
requesting consideration of a restricted left-turn lane on the northbound Denton
Tap Road between the existing median opening at Braewood Drive and the open-
ing into Minyards/McDonalds.
After reviewing the matter with our client Mr. Ardinger, it is his desire to go ahead
with installation of the left-turn lane for which he would be willing to absorb the
cost. Since construction is at a stage that would allow installation with minimal dif-
ficulty, we respectfully request your review of this matter and advising us on the
possibility of construction.
In discussions with Shohre I have questioned whether a variance is really the
proper method inwhich to handle this matter or whether a simple interpretation is
required by the City to allow the installation.
As Mr. Kurtz indicated in his letter, this left turn lane is extremely important to the
proper development of the subject property and as I indicated in our meeting on
February 16, 1989 - we have been operating under the assumption we had tacit ap-
proval when we previously submitted for preliminary plat. ~
