I met with Bruce Stockard the City Attorney and John Karlsruher of Ginn, Inc.
this morning to review the above referenced easement dedication documents.
We first identified locations of where necessary easements are proposed for
dedication, and verified that they are provided where needed.
We then reviewed one of the nine sets of submitted - easement documents from a
legal standpoint. There were generally some concerns, according to Bruce, and
they are listed below~
- Generally, they appear to be only one sided to the advantage of the
grantor, not the City.
The easement dedication forms are not uniform easement dedication forms,
and therefore, they require extensive review by Staff, especially by
legal council.
The Grantor is reserving his (her) right to use said easements as they
deem necessary, such as for roadways, parking lot, landscaping, placing
fences, signs, pavement, etc.
Bruce will provide his comments on all documents early next week. In the mean
time, I will contact Bill Anderson of Dan M. Dowdy requesting that he use
standard easement forms~ although he may challenge our request, and/or add
certain wordings to them.
I will keep you informed of this matter, and at that time, upon your direction,
we will prepare a City Council Agenda item, for council's consideration.
