Dear Alan:
A t~ief follow up to our meetinG of September 7th on the referenced topic.
I have sent my partners in the Parks of Coppell Joint Venture II a sunmary
of the proposed ]~thod of accc~plishing the McArthur Extension which we
discussed, and also have asked our attorney to get in touch with Larry
Jackson and Jeff Hurt to Generally discuss it frc~ a legal point of view.
Our attorr~y is leaving town late this week until 9/29 so I am hopeful
that some documents could be ready for his review by the time he returns.
After thinking further about the assurances we need frc~ the city
regarding the extension of the autc~natic termination dates on the Park
Donation Agreement and the Preliminary Plat, it is ray reccxan~ndation to my
partners that we request the city to extend these dates until one year
past the cornpletion of the McArthur extension. Under the circumstances I
think this is only fair to our partnership. We invested a great deal of
time and money working out those agreements with the city in 1987 on the
expectation that the McArthur Extension would have co~n~nced sc~ne time
ago. The development plan which the city approved for that property is
highly dependent upon the existence of McArthur; therefore I believe the
City should allow us a reasonable period of time after McArthur is
cc~plete to cause the Oevelopment of that tract in the manner contemDlated
by the agreements with the city.
We will expect such assurances to be part of the dedication process.
Therefore I am hopeful you can investigate what you need to do on your end
to deliver them. Please call if you have any questions.
