CURRENT ZONING: Light Industrial (LI) REQUEST: Approval of a zoning change from Light Industrial (LI) to Light Industrial Special Use Permit (LI.S.U.P.). APPLICANT: Mr. Fred Shade 617 Loch Lane Coppell, TX 75019 HISTORY: A commercial strip center was built on this site in the mid 80's. Item 6 TRANSPORTATION: Traffic enters this site via Beltline Road and Wrangler Dr. SURROUNDING LAND USE & ZONING: North - Vacant; (LO zoning South - Vacant; (LI) zoning East - Vacant; (LI) zoning West - Middle school; (C) zoning COMPREHENSIVE PLAN: The comprehensive plan suggests light industrial uses for this area. ANALYSIS: The applicant is requesting approval of a paint and body shop, in the Nikor Commerce Center. He presently operates a paint and body shop located in Dallas, but he states most of his customers reside in Coppell and would like to relocate in Coppell. Other tenants within the center include a church and an auto repair shop. In the near future, the YMCA plans to relocate within this center. The cars will remain indoors and night and will not be parked in the parking lot. ALTERNATIVES: I) Approve the special use permit request. 2) Deny the plat special use permit request. 3) Modify the special use permit request. You confirmed that the committee approved the special use permit at Nikor Commerce Business Center and that the committee unanimously approved the request but stipulated in its approval certain requirements with respect to parking, sate-of-the-arts technology and the fact that all waste material be removed on a regular basis, by a professional waste disposal company. You also indicated that planning and zoning files have documentation and pictures evidencing these facts. Coppell City Council Environmental Concerns regarding Special Use Permit request # 5-1069 from Mr. Fred Shade 1) 2) 3) The proposed paint and body shop has no volatile organic compound (VOC) emission controls. All VOCs generated during operations will be exhausted to the outside where they can be drawn into other tenants fresh air intake ducts. Due to the close proximity of tenants, particularly those serving children, I believe there is a high probability that tenants and their customers will be exposed to VOCs at concentrations above the Texas Air Control Board Health Effects Screening levels. An environmental and area safety impact assessment could not be made because the following information was not provided by Mr. Shade for review: a) Material Safety Data Sheets for proposed chemical usage b) Projected chemical usage in gallons per month c) Details concerning chemical storage facilities for virgin and waste materials ( including flammables) d) Details concerning chemical use activities which will be performed outside the paint booth e) Details of any activities which could result in discharge of chemicals to the sanitary sewer system The operation is likely to be exempt from Texas Air Control Board and Texas Natural Resources Conservation Commission regulations with regard to air emissions and hazardous waste. Therefore, the city of Coppell can not rely upon these agencies to enforce environmental regulations. If the SU.P. is eventually granted, the best way to protect against environmental and health problems in the area is to write specific provisions into the S.U.P. to address these concerns. At a minimum, it appears that add on equipment should be required to dramatically lower the V.QC. emissions from the paint booth exhaust stack. In addition, adjoining tenant walls should be air tight and the S.U.P. approval tied to Texas Air Control Board Health Effects Screen- ing Levels. These levels should be the maximum concentrations of VOCs to which tenants and customers in the complex should be subject. Provisions should also be established to fund periodic inspections to verify that compliance with State and Federal regulations and S.U.P. stipulations is maintained. Failure to abide by these regulations and stipulations should result in closure of the business if not corrected in a timely fashion.
