Law Suit Against the City; Moore Road Between
and Havencrest at Alley
Shadowcrest
A resident living in the general area described above has filed
a suit against the City after she twisted her ankle in the alley
between Shadowcrest and Havencrest on February 9, 1987.
Please review your daily operator's reports as well as your
overtime reports between 12/6/86 and 2/9/87 to see if your
respective divisions for whatever reason may have excavated or
brought fill into this area du~ing that time. My inclination
is to say that this did not happen since the improvements taking
place was a C.I.P. project.
The City's position in the law suit is that we did not excavate
or bring fill into this area, but before this goes to court I
would like this verified.
The City's Attorney, Ron Clark (214/893-9421) has requested this
information. If you think there are other files which contain
information where this could be stored, please review'.
I need your response by noon, Monday, October 23, 1989.
