the amount of $58,630.42 from Ashlar Contracting Company, for
work performed on the above referenced project through April 30,
1987.
We have reviewed this application and recommend that the City of
Coppell release payment for only $45,000 at this time. The
remaining amount outstanding per this contract should be withheld
until the project is fully completed and a final settlement can
be negotiated. This recommendation is consistent with the
Contract Documents and Specifications, Section 5.08, Payments
Withheld. Our basis for this recommendation is due to the
following items not yet resolved=
1. Actual completion date exceeds original contract
completion date (Nov. 1, 1986} by an excess of 180 calendar days.
2. Damage claims exceeding $25,000 in claimed value still
unresolved and Ashlar has not yet sent the City of Coppell
statements of indemnification to hold harmless the city of
Coppell for these claims as required per the Contract Documents
and Specifications, Section 3.17, emni ' a 'on.
3. Deficiencies in the work estimated at approximately
$20,000 for replacement cost still unresolved.
At final completion of this project, we shall attempt to
negotiate a fair settlement for both parties involved and bring a
recommendation forward to the City Council for consideration.
