condemnation letter, similar to the one enclosed herewith, regarding
the existing pool and other structures that are located ~rlthin the
20w drainage md utility easement on the rear of the property. The
pool was built in 1980, and Ray Gonzales of the Public gorka Department
has detemined that there are no utilities or sever or drainage pipes
located within the easement.
AN~ICAI~ TITLE CO~AW/ requests that the City Coancil, at its special
aeeting on ltarch 16, get a consensus of council so that this letter
request vi11 be brought before the Council on their next regular ~eeting
on 1 larch 22, 1994.
It is our understanding that the Council has granted similar requests
to other ho~eoemers in the City of Coppell and that we can have the
assurance that the sa~e consideration erlll be given the hoaeovner at
526 Rolling Hills in Coppell.

The by-laws for our Board of Adjustment provide that staff may release~' (pr[(~r to the Zoning
Board of Adjustment hearing the case), a non-condemnation letter if the structure in question
has existed for a period of time mid the structure is changing hands. In this case, the property
is being sold.
The City of Coppell acknowledges that an encroachment has occurred and the City does not
intend to condemn the structure or initiate a lawsuit to correct the violation.
