ACKNOWLEDGE THAT THE FENCE WHICH IS LOCATED ON THEIR PROPERT~
ENCROACHES ONTO THE CITY OF COPPELL ' S DRAINAGE EASEMENT;
AND
WHERF-J~, THE OWNERS UNDERSTAND AND ACKNOWLEDGE THAT IN CASE
REPAIRS OR IMPROVEM~NTS ARE REQUIRED TO BE MADE TO THE CITY OF
COPPELL'S DRAINAGE EASEI~ENT WHICH wOULD REQUIRE p. EMOVAL OF
FENCE IN ORDER TO EFFECT SUCH IMPROVEM]~NTS; AND
WHEREAS, THE OWNERS RECOGNIZE AND ACKNOWLEDGE THAT SUCH FENCE
WAS INSTi~?J'RD DESPITE KNOWLEDGE OF THE CITY'S DRAINAGE EASEMENT;
OWNERS HEREBY AGREE TO REMOVE SUCH FENCE AT T~IR OWN COST AND
UPON REQUEST BY THE CITY OF COPPELL, AND IF OWNERS FAIL TO REMOVE
T~E FENCE UPON REQUEST BY THE CIT~, THEN CITY WILL REMOVE SUCH
FENCE ~ OWNERS HEREBY INDEMNIFY AND HOLD THE CITY HAR/4LESS FROM
ALL CLAIMS OF DAMAGE TO THE FENCE WHICH ARISE FROM THE CITY'S
REMOVAL OF SUCH FENCE WHILE REPAIRING, INSPECTING, IKPROVING OR IN
